Rule 46. Payment of Jail Costs by Inmate
The Court shall require a person held in the county jail to pay actual costs, (set forth below) determined by the County Sheriff and in accordance with O.S.Title 22, Sec. 979a (as amended) and controlling published case law, as follows:
1. Food and maintenance for each day of incarceration both before and after conviction in misdemeanor cases, for jail terms in any deferred sentence, and commitment prior to sentencing in felony cases where Oklahoma Department of Corrections' custody sentence is ordered, in an amount not to exceed that county sheriff's actual costs of food and maintenance for incarceration, and;
2. Medical care, if any, and;
3. Dental care, if any, and;
4. Psychiatric services.
5. No double-charging of costs.
6. The Sheriff is entitled to only one full recovery of jail costs. The Sheriff cannot recover from both the Department of Corrections under Okla. Stat. Title 22, Sec. 991a-2 (as amended), or Sec. 991a-4.1 (as amended) and payment of jail costs by an inmate under Okla. Stat. Title 22, Sec. 979a (as amended) thereby receiving more than one full recovery for the actual costs of food, maintenance, medical, dental, and psychiatric care. If an inmate is confined in the county jail on multiple cases the inmate shall reimburse the Sheriff only in one case, and pursuant to other rules promulgated herein.
7. A hearing shall be held annually for the District Judge to decide the reasonable rate to be charged for such costs in each County.
