Rule 47. Amendments by Interlineation or Redactions: and, Amendment of Felony Case to Misdemeanor Via Plea Agreement
Amendments by “Interlineation” or “Redaction” are to be used only for correction of scrivener's or typographical errors in any case, and not for substantive amendment of charges against an individual defendant, except as allowed by the Judge presiding in the case.
If a Felony case is filed and ultimately disposed via plea agreement by dismissal of the felony charge(s) and some form of guilty plea is entered to existing misdemeanor charges therein, or if a felony charge is amended to a misdemeanor charge(s) pursuant to a plea agreement and no felony charge remains pending in the felony case, then the felony case shall be dismissed and a misdemeanor case filed and proceeded thereon. This is to alleviate any unnecessary hardship, confusion, or frustration upon a person with solely either a misdemeanor conviction or misdemeanor deferred probation, and yet official records would reference a felony “CF” case file number.
