Rule 9.5. Stays
After a trial court has issued a Judgment and Sentence of death, the execution date is automatically stayed by operation of law in order that this Court may conduct its mandatory sentence review as enumerated in Rule 9.4. PROVIDED HOWEVER, trial counsel shall submit to this Court an application for stay of execution at the time the notice of intent to appeal and designation of record is filed.
