Rule 40. Jury Sessions--Civil and Criminal
All cases placed on any jury docket shall be set for a day certain. On whatever date the cases are set, they may be called for trial in order of their settings on a trailing docket. If more cases are set on any day than can be tried, they shall be continued to a day certain later on the docket. The following statement of procedure may be helpful:
(a) A copy of the Jury Trial Call Docket shall be mailed to counsel of record approximately ten (10) days prior to the commencement of the docket sounding.
(b) Criminal and Civil cases will be set for trial on a day certain by docket except where modified for good cause by the presiding Judge or for special terms. Criminal cases require appearance by the defendant and counsel on a docket sounding date to be fixed by the presiding Judge.
(c) All motions in felony cases must be filed and service made at least by the date and time as ordered in the published felony docket, except for good cause shown, and hearings on all such motions will be held by order of the Court for special setting prior to trial.
(d) Plea bargains will not be accepted once a case is ordered set for jury trial to begin on a date certain unless allowed by the presiding Judge. The deadline for presentation of plea agreements will be published on the call docket with a deadline date fixed by the presiding Judge.
(e) Jury trials shall take preference as to courtroom scheduling. Criminal jury trials will take preference to civil jury trials for courtroom scheduling.
(f) Counsel shall keep the presiding Judge apprised of the settlement or trial status of their cases on the docket.
(g) Jury trials start promptly at 9:00 a.m. unless otherwise announced.
(h) The presiding Judge only shall continue any case for good cause shown. Cases may be reassigned or dismissed for good cause shown.
