Rule 38. Domestic Relations--Ex Parte Orders
When an ex parte order Pendente Lite is obtained, it shall be drawn in the alternative, requiring the act to be done on or before a specified time or that the party appear before a Judge to voice any objection. The following form is recommended if there is not otherwise applicable statutory directive language, (which shall then control):
“Instead of performing this Order, you may appear in person before Judge __________ of this Court at __________ o'clock __________.m. on the ___ day of __________, __________, to object or contest any of the things it requires you to do. If you do not appear at that time, it will be evidence that you agree to obey the Order, and if you later disobey it, performance may be enforced by legal process. If you know you will not appear to object, so advising the attorney whose name, address and telephone appear herein forty-eight (48) hours or more before the hearing time may save attorneys fees, court costs, other people's time, and may contribute toward an acceptable solution of the problems between you and your spouse.”
