Rule 34. Guardians Ad Litem and Criminal Appointments
It is the duty of all the members of the Bar to accept their proportionate share of the profession's responsibility to represent indigent persons in both civil and criminal matters. All members of the Bar residing in the 1st Judicial District who represent parties before this Court in fee-generating cases or matters shall be expected so to serve unless previously excused by the Court for good cause. The Court shall appoint its officers to represent indigent or those otherwise unable to get their own attorney, and shall expect such appointees to perform to their highest professional capacity.
No Judge will entertain the suggestion that any particular attorney be appointed and paid by the Court to represent any party. No attorney shall suggest to any indigent person that a Judge be requested to appoint that attorney or any other specific person to represent such indigent person. It shall be the rule of this Court that no lawyer having received any previous private financial compensation associated with the case be appointed to represent any indigent person associated with that case, unless the exigencies of a particular situation require otherwise.
If court-appointed counsel discovers their client is financially able to pay for legal services, that fact shall be immediately disclosed to the Court, so that the appointee may be released.
It shall be a violation of the Rules of this Court for appointed counsel to accept private compensation from any source other than the Court or OIDS or Legal Aid Services for the representation of any indigent.
