Rule 4.4. Guardian Ad Litem
A guardian ad litem may be appointed to the minor children upon order of the Court or upon motion of either or both of the parties. An agreed order appointing guardian ad litem shall be submitted by the parties to the Court for approval.
A. Each party shall pay an initial fee of $500 within ten days of appointment. Additional fees shall be paid as per order of the Court or as agreed to by the parties.
B. If the GAL is not paid within the ten day time frame, the GAL shall notify the attorney for the party that has not paid and the attorney shall contact their client to make payment.
C. The GAL will not be obligated to file a report until such time as the initial payment is made.
D. If there are circumstances in which a report is needed and only one party has paid their portion of the fee, the matter should be brought to the attention of the trial judge as to how the GAL is to proceed.
E. After the GAL has submitted their report, and all parties have had an opportunity to review the report, attempted to settle the matter and the parties continue to request a hearing, a second GAL fee will be assessed. The party responsible for the fee will be determined by the trial judge depending on the circumstances at the time the request for hearing is made. Said payment is to be made prior to hearing.
F. Should the GAL submit a report in a timely manner and the matter continue to be delayed for such a period of time that the parties request an additional report because of the lapse of time, and additional fee may be assessed to be paid prior to any supplemental reports.
