Rule 24. Discovery
Since the Court, the prosecution, and the members of the Bar are primarily responsible to achieve fairness and justice in each and every judicial matter, the 25th Judicial District does hereby enact the following court rule which will more adequately provide the desired atmosphere of fairness, justice, and equality in every criminal discovery matter. It is not our intent to supersede the provisions of the Oklahoma Criminal Discovery Code as is set forth in 22 O.S. § 2001 and 2002; 22 O.S. § 761 et seq.; or 22 O.S. § 258, simply to make the compliance of these statutes more equitable for all parties involved.
Both the prosecution and the defense attorneys shall diligently comply with every provision and all requirements of the Oklahoma Discovery Code and similar statutes in a timely fashion, always being cognizant of their ethical duty to see that justice is accomplished.
Further, in an effort to provide for the fair exchange of evidence, the Court shall set a mutual discovery date and a date for all motions to be filed at the felony disposition docket. By that date, all known trial evidence and witnesses shall be exchanged by the parties. Any evidence which is not exchanged by this date and which was known or reasonably should have been known by its proponent may be subject to the sanctions set forth in 22 O.S. § 2002 (E) (2).
