Rule 41. Request for Court Reporter
In Pottawatomie County, by reason of the shortage of available court reporters, upon the filing of any Civil action, including but not limited to small claims, litigants are to be advised by the Court Clerk's office of the necessity of requesting and depositing the statutory fees pursuant to 28 O.S. 152.1 for the reporter to report a proceeding. A request for a reporter and deposit of statutory fee shall be made at the time of demand for hearing or trial, but in no event later than 48 hours prior to said hearing.
Litigants are advised the failure to provide requisite notice to the Court and the deposit of the required statutory fees may result in a continuance of the proceeding. The trial or hearing judge will retain the case for possible assessment of costs or attorney fees in the event it is determined the failure to request and deposit the statutory fees resulted in otherwise unnecessary delay.
Litigants requesting a reporter shall provide on the record at the commencement of the proceeding the date and receipt number reflecting the payment of the reporter fee.
