Rule 9. Criminal
An attorney shall file an Entry of Appearance in order to be recognized by the court. An attorney for the defendant in a criminal case may not withdraw, except for good cause shown, less than thirty (30) days preceding a scheduled Court appearance. (Motions/Orders must comply with Rule 11) “Good cause shown” does not mean that the attorney has not been paid. A preliminary hearing shall not be continued more than twice (rule of thumb: each side may request one continuance for good cause with approval of the assigned judge). If a Motion for Continuance and Order is granted by the assigned judge, the defendant must still appear to be recognized back unless specifically excused by the assigned judge. The court may either issue a bench warrant and bond forfeiture or take them under advisement for defendants who fail to appear. Pursuant to administrative hearings, the daily cost of incarceration in the Washington and Nowata county Jails has been established. A daily jail assessment may be made by the judge pursuant to 22 O.S. 979a at the time of sentencing. A copy of the Order Establishing Daily Costs for Jail can be obtained from the court clerk's office. Attorneys shall have all plea paperwork filled out completely prior to presenting a case for plea.
