PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
Amendment of section 80-3.14 of Title 8 NYCRR.
Statutory authority:
Education Law, sections 101, 207, 208, 305, 308, 3001, 3004 and 3009
Subject:
Implementation timeline for the Computer Science Statement of Continued Eligibility (SOCE).
Purpose:
To extend the implementation timelines for the Computer Science SOCE in response to the COVID-19 pandemic.

Initial Review of Rule
As a rule that requires a RFA, RAFA or JIS, this rule will be initially reviewed in the calendar year 2025, which is no later than the 3rd year after the year in which this rule is being adopted.
Assessment of Public Comment
Since publication of the Notice of Proposed Rule Making in the State Register on June 29, 2022, the State Education Department (Department) received the following comment on the proposed amendment:
1. COMMENT: The commenter requested that the Department consider posting the Initial Computer Science certificate application for applicants and school districts that are ready to hire teachers and assign them to the computer science tenure area. They suggested adding a Superintendent’s Statement to the application in the Department’s TEACH system to solve the issue of anyone applying for the certificate. The commenter further suggested that the additional certificate pathway should be made available with a Superintendent’s Statement in the TEACH system along with the New York State-approved teacher preparation program pathway. They shared that their district hired a teacher who is teaching only computer science coursework and stated that pushing back the certification date negatively impacts districts that are ready to hire computer science teachers.
DEPARTMENT RESPONSE: The Department anticipates making all pathways for the Initial Computer Science certificate application available in the fall of 2022. The application would reflect the requirements listed in the Commissioner’s regulations, which do not include a Superintendent’s Statement (e.g., an employment and support commitment that districts complete in the TEACH system). No changes to the proposed rule are necessary.
