PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
This is a consensus rule making to amend section 44.3(a) of Title 15 NYCRR.
Statutory authority:
Vehicle and Traffic Law, sections 215(a) and 375(41)(6)
Subject:
Colored Lights; amber lights.
Purpose:
To conform the regulation to the statute.
Text of proposed rule:
Subdivision (a) of section 44.3 is amended to read as follows:
(a) One or more amber lights may be affixed to a hazard vehicle as defined in section 117-a of New York State Vehicle and Traffic Law [is every vehicle owned and operated by a utility, whether public or private, used in the construction, maintenance and repair of its facilities, every vehicle specially equipped or designed for the towing or pushing of disabled vehicles, and every vehicle engaged in highway maintenance, or in ice or snow removal where such operation involves the use of a public highway].

Consensus Rule Making Determination
This amendment is required to update subdivision (a) of Part 44.3 of the Commissioner’s Regulations, which relates to permitting one or more amber lights to be affixed to a “hazard vehicle.” There have been recent statutory changes to the definition of a hazard vehicle so that the description of what constitutes hazard vehicles as set forth in the current regulation is now inaccurate. By replacing the description of hazard vehicles with reference to section 117-a of the Vehicle and Traffic Law (the definition of a hazard vehicle), the regulation will conform to the current law and will also eliminate having to amend the regulation in the future should the definition of a hazard vehicle change.
This is submitted as a consensus rule because this is a minor technical change.
