Department of Health
The New York State Department of Health (DOH) is required by the provisions of the federal Beaches Environmental Assessment and Coastal Health (BEACH) Act to provide for public review and comment on the Department’s beach monitoring and notification plan. The BEACH Act (Section 406(b) of the Clean Water Act) enacted a federal Environmental Protection Agency grant program available to states, such as New York, with coastal recreational waters. Coastal recreational waters include the Great Lakes and marine coastal waters that are designated for swimming, bathing, surfing, or similar water contact activities. The Act is not applicable to inland waters or waters upstream of the mouth of a river or stream having an unimpaired natural connection with the open sea.
The beach monitoring and public notification plan also includes information on the beach evaluation and classification process, including a list of waters to be monitored and beach ranking. Also included in this plan, is the sampling design and monitoring plan, including sampling location and sampling frequency. Lastly, the plan contains information on procedures for public notification and risk communication, including methods to notify the public of a swimming advisory or beach closure.

New York City Deferred Compensation Plan

In F-2019-0336, the applicant, Staten Island Terminal, LLC, is proposing to construct a small, narrow jetty in association with construction of a deep water port, Staten Island Terminal at 2535-2541 Richmond Terrace on the kill van Kull, Staten Island, Richmond County, NY. The purpose of the proposed jetty is to allow the landing, unloading, storage, and distribution of dry bulk cement and stone aggregate imported by ocean-going freighters. The current site is used for the storage and distribution of stone, cement, lime, construction sand, gravel, and other construction materials. Nearly all of the site is paved with minimal vegetation and there is no pier.
The proposed components to be installed include a 625’ x 44’ caisson supported jetty pier extending 16 feet over mean low water, encompassing approximately 0.63 acres, with a height of 16 feet over mean low water to accommodate cargo vessels; an approximately 700’ long x 21’ wide elevated trestle pier and conveyor system and a truck loading platform fed by two cement silos with a capacity of 375 tons of dry cement each.
To accommodate the cargo vessels, Staten Island Terminal, LLC proposes to drill, blast, and dredge approximately 60,000 cubic yards of material to deepen the water depth of the channel to 42 feet. Drilling and dredging activities are expected to last two to three weeks. Blasting activities are anticipated to last eight days. Erosion and sediment control best management practices will be employed. Dredged material will be disposed of off-site in an approved location. Topsoil and upper subsoil will be stockpiled for reclamation. Construction of a jetty structure was considered to require the least amount of dredging and blasting compared to other options.
The proposed activities would be undertaken within the New York City Waterfront Revitalization Program (WRP) planning area. As the WRP is a component of the NYSCMP, activities under federal permitting authority are also subject to review for their consistency with the local program and its specific provisions and policies. In F-2019-0369 (DA), Amtrak (Federal Railroad Administration) is proposing to replace an existing deteriorated eastern portion of a swing bridge and to replace the deteriorated timber fender system with a new steel and concrete fender system with timber facing. The railroad swing bridge crosses Spuyten Duyvil Creek (Harlem River) at the Hudson River between Manhattan and the Bronx and utilizes an Amtrak right of way. The west portion of the fender system was replaced in 2008. The upgrade of the fender t the proposed steel system on the east side of the pivot pier is essential to the protection of the operation of the Spuyten Duyvil Bridge, which is a key element of infrastructure in Amtrak’s Empire Line service.
The proposed activities would be undertaken within the New York City Waterfront Revitalization Program (WRP) planning area. Kennedy International Airport” is consistent with the New York State Coastal Management Program (NYSCMP) and the New York City Local Waterfront Revitalization Program (WRP). The EA was prepared in cooperation with the New York State Department of Environmental Conservation, the U.S. Department of the Interior, Fish & Wildlife Service, the National Park Service, the Port Authority of New York and New Jersey, and the City of New York Department of Environmental Protection.
The FAA has a multi-year Interagency Agreement with USDA/APHIS/Wildlife Services located in Sandusky, OH. FAA approval is required to continue or modify the program. The current preferred alternative proposes a continuation of the current wildlife damage management program at John F. Kennedy Airport (JFK). The current program employs Integrated Wildlife Damage Management approach to reduce conflicts with wildlife. This approach employs both lethal and non-lethal methods to address target wildlife populations.
