Waiver of Retirement Requirements for a Generation Facility Located in Dunkirk, New York
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On 8/16/12, the PSC adopted an order denying the petition of Dunkirk Power LLC and NRG Energy, Inc. for a waiver of the 180-day notice period so that it could mothball the generating units prior to the expiration of the notice period.
Statutory authority:
Public Service Law, sections 5(1)(b), 65(1), (2), (3), 66(1), (3), (5), (10) and (12)

Purpose:
To deny a waiver of retirement requirements for a generation facility located in Dunkirk, New York.
Substance of final rule:
The Commission, on August 16, 2012 adopted an order denying the petition of Dunkirk Power LLC and NRG Energy, Inc. for a waiver of the 180-day notice period so that it could mothball the generating units prior to the expiration of the notice period, subject to the terms and conditions set forth in the order.
