PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering whether to adopt, modify, or reject, in whole or in part, the joint petition for rehearing, which was filed in response to the Commission's Order issued on June 13, 2014.
Statutory authority:
Public Service Law, sections 4(1), 5(1)(b), (2), 65(1), 66(1), (2), (4), (5), (9) and (12)
Subject:
Refueling options for the Dunkirk generating station located in Dunkirk, New York, and alternatives.
Purpose:
To address the joint petition for rehearing of the Commission's Order related to refueling the Dunkirk generating station.
Substance of proposed rule:
The Public Service Commission (Commission) is considering whether to adopt, modify, or reject, in whole or in part, the joint petition for rehearing of the Commission's Order issued on June 13, 2014 that was filed by Sierra Club and Earthjustice, on behalf of the Ratepayer and Community Intervenors on July 14, 2014, and may address other related matters.
