PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering granting, denying or modifying, in whole or in part, petitions for rehearing, reconsideration and/or clarification filed in response to the Commission's February 25, 2014 Order in Cases 12-M-0476 et al.
Statutory authority:
Public Service Law, sections 5(1)(b) and 66(1)
Subject:
To consider petitions for rehearing, reconsideration and/or clarification.
Purpose:
To consider petitions for rehearing, reconsideration and/or clarification.
Substance of proposed rule:
On February 25, 2014, the Public Service Commission (Commission) issued an Order Taking Actions to Improve the Residential and Small Non-Residential Retail Access Markets (Order) in Cases 12-M-0476, 98-M-1343, 06-M-0647 and 98-M-0667. On March 27, 2014, the Retail Energy Supply Association filed a Petition for Rehearing, Reconsideration and Clarification; the National Energy Marketers Association filed a Petition for Clarification and/or Rehearing; and Constellation NewEnergy, Inc. filed a Petition for Rehearing, Reconsideration and Clarification in the above referenced proceedings. On March 31, 2014, Great Eastern Energy filed Comments and a Request for Clarification regarding the above referenced Order. These filings asserted errors of fact or law in, or raise concerns with, the resolution of a number of issues in the Commission’s Order. Further, the filings requested modification to the resolution of certain issues contained in the Order. The Commission is considering whether to grant, deny or modify, in whole or in part, the relief sought in the above referenced filings. The Commission may also address related matters.
