PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
Amendment of sections 4020.1(e) and 4043.2(e) of Title 9 NYCRR.
Statutory authority:
Racing, Pari-Mutuel Wagering and Breeding Law, sections 103(2), 104(1), (19), 301(1), (2) and 902(1)
Subject:
Anti-stacking of NSAIDs, add diclofenac (HA) and delete meclofenamic acid from 48-hour NSAIDs.
Purpose:
To enable the Commission to preserve the integrity of pari-mutuel racing while generating reasonable revenue for the support of government.

Initial Review of Rule
As a rule that does not require a RFA, RAFA or JIS, this rule will be initially reviewed in the calendar year 2023, which is no later than the 5th year after the year in which this rule is being adopted.
Assessment of Public Comment
The Commission received public comments from the New York Racing Association, Inc. (NYRA) and from a horse trainer who is a director on the board of the New York Thoroughbred Horsemen’s Association (NYTHA) and chair of NYTHA’s race horse aftercare committee. Both comments were in support of the revised proposal.
