Pursuant to 42 CFR Section 447.205, the Department of Health hereby gives public notice of the following:
The Department of Health proposes to amend the Title XIX (Medicaid) State Plan Amendment for non-institutional services to improve health outcomes for individuals with Sickle Cell Disease. The following changes are proposed:
• Effective on or after September 1, 2021, the Health Home Program will expand single-qualifying conditions to include Sickle Cell Disease. This will allow adults and children diagnosed with Sickle Cell Disease to enroll in the program in the absence of another qualifying condition. This update is in response to the recommendation made by an expert panel convened to improve outcomes for people with Sickle Cell Disease in New York State as a result of the 2020 Medicaid Redesign Team II initiative.
The estimated annual net aggregate increase in gross Medicaid expenditures attributable to this initiative contained in the budget for state fiscal year 2021/2022 is $1.29 million.
The public is invited to review and comment on this proposed State Plan Amendment, a copy of which will be available for public review on the Department’s website at http://www.health.ny.gov/regulations/state_plans/status. The Office of Mental Health and the Department of Health propose to amend the Title XIX (Medicaid) State Plan for institutional services related to temporary rate adjustments to Article 28 Hospitals that are undergoing a restructuring to protect and enhance access to care, quality of care and the health care delivery system. These payments are currently authorized by Section 2826 of the New York Public Health Law. The following changes are proposed:

In F-2021-0535, Blind Sodus Bay Western Bluff REDI Project, the applicant, Wayne County Soil and Water Conservation District, is proposing construct a 900 linear foot reinforced earth full height stepped gabion wall, soil nailing to stabilize a 190 linear foot existing bulkhead and placement of extra-large rip rap at the toe of both the new gabions and existing bulkhead. The purpose of the proposed activity is to stabilize the existing 12 foot to 42 foot high lake shore bluff to protect existing public infrastructure and further property loss at the top of the embankment.
The site is located at the western bluff at Blind Sodus Bay in Town of Wolcott, Wayne County, along Blind Sodus Bay and Lake Ontario.

In F-2020-0629, or the “Clayton French Creek Marina Dredging Project”, the applicant – New York State Office of General Services – proposes to dredge an area of approximately 3.9 acres total to an elevation of +239.8 feet IGLD85 (-3.5 feet LWD) within the marina, plus a 0.5 foot overdredge allowance. Dredged material will be disposed of at the Development Authority of the North Country (DANC) Materials Management Facility located in Rodman, New York approximately 22 miles south of the project site. The proposed dredge limit is approximately 750 feet long and 400 feet wide with the eastern portion of the proposed dredge limit split into two channels that are approximately 100 feet wide and 150 feet wide, respectively. The proposed dredge limit footprint equals approximately 3.9 acres.
The purpose of the proposed project is to “dredge within a portion of Clayton French Creek Marina and dispose of dredged material at an upland disposal facility as directed by NYSOGS in order to: Increase access for recreational vessels within a portion of Clayton French Creek Marina; support the local economy, commercial functions, and recreational activities that depend on the marina; Minimize environmental impacts while conducting dredging activities.” The project will occur at the Clayton French Creek Marina, in the Town of Clayton, Jefferson County.

In F-2020-0651, or the “Olcott Harbor Dredging Project”, the applicant – New York State Office of General Services – proposes to dredge up to 2,000 cubic yards of material will be dredged from approximately 0.8-acre of Olcott Harbor to an approximate elevation of 236.8’ International Great Lakes Datum of 1985 (IGLD85) plus an over dredge allowance of 12-inches. The proposed 2021 dredging is consistent with the previous dredging effort that was completed by the Town of Newfane in 2014 under NYSDEC permit #9-2928-5 00049/00006; expired in 2019). Dredged spoil material will be managed and disposed of in accordance with local, state, and federal regulations at an upland location that is acceptable based on the sediment chemistry. The sediment is currently anticipated to be windrowed over approximately 0.1 acre at the Town composting facility, covered by topsoil, seeded, and left in place.
The purpose of the proposed project is to “provide access to Eighteenmile Creek for small vessels when lake levels are low”. The project will occur at Olcott Harbor, in the Town of Newfane, Niagara County at the mouth of Eighteenmile Creek and Lake Ontario.

In F-2020-0669, or the “Morristown Harbor Federal Navigation Channel”, the applicant – New York State Office of General Services – proposes to dredge an area of approximately 1.5 acres total to an elevation of +234.7 feet IGLD85 (-8.0 feet LWD) within the marina, plus a 1.0-foot overdredge allowance. Dredged material will be disposed of at the Development Authority of the North Country (DANC) Materials Management Facility located in Rodman, New York approximately 47 miles south of the project site.
The purpose of the proposed project is to “maintain navigation within the channel; supplement the USACE ongoing operations and maintenance efforts with a one-time dredge event; support the local economy, commercial functions, and recreational activities that depend on the navigation channel”. The project will occur at Morristown Harbor in the Federal navigation channel, in the Town of Morristown, St. Lawrence County on the St. Lawrence River near Morrison Bay.

In F-2021-0701 (DA), The National Oceanic and Atmospheric Administration (NOAA) National Marine Fisheries Service (NMFS) has presented Amendment 21 to the Atlantic Sea Scallop Fishery Management Plan (FMP) is to allow for more controlled access to the scallop resource by the limited access and limited access general category (LAGC) fleets and increase monitoring in ways that support a growing directed scallop fishery in Federal waters, including the Northern Gulf of Maine (NGOM). Another purpose is to consider adjusting the LAGC individual fishing quota (IFQ) program to support overall economic performance while allowing for continued participation in the LAGC fishery at varying levels.

In F-2021-0718 (DA), The National Oceanic and Atmospheric Administration (NOAA) National Marine Fisheries Service (NMFS) has presented Amendment 7 to the Atlantic Bluefish Fishery Management Plan. The purpose of this action is to update the Bluefish FMP using the best information available by revising quota allocations and management procedures. This amendment would: Revise the Bluefish FMP goals and objectives; establish updated allocation percentages of bluefish quota between the commercial and recreational fishery sectors, as well as commercial quota among the states of Maine through Florida, to be applied through future specifications actions; initiate a rebuilding plan for the bluefish stock that was declared overfished in 2019; revise the procedures to transfer quota between commercial and recreational fishery sectors; and revise administrative measures that determine how the FMP accounts for management uncertainty.
