2018 Hudson River Estuary Grants for River Access Under the New York State Environmental Protection Fund
Applications will be accepted through 3:00 p.m. August 22, 2018 for grant funding under the 2018 Hudson River Estuary Grants Program. Anticipated grant funds from the New York State Environmental Protection Fund (NYS EPF), and the Natural Resource Damages Fund (NRD) is approximately $950,000. This is a competitive grant program and projects must implement priorities of the Hudson River Estuary Action Agenda identified in the application. The Hudson River Estuary Action Agenda can be viewed at http://www.dec.ny.gov/lands/5104.html. Projects eligible for state assistance must be located within the geographic boundaries of the Hudson River Estuary, and for NRD funds, projects must be located in the Village of Sleepy Hollow or Village of Tarrytown on publically accessible lands. The recipient must provide a match of at least 15% of the grant funding amount.
Applications must be completed online and are available on the New York State Grants Gateway at https://grantsgateway.ny.gov. Rural Volunteer Fire Assistance
Pursuant to the Agriculture Appropriations Act, Section 7(b)3 of P.L. 95-313 (Cooperative Forestry Assistance Act of 1978), the New York State Department of Environmental Conservation hereby gives notice of the following:
The New York State Department of Environmental Conservation (The Department) will administer the 2018 Volunteer Fire Assistance (VFA) Grant program to assist eligible rural fire departments in the purchase of eligible wildland fire suppression equipment. VFA applications will be accepted through August 10, 2018.
The Department received a federal appropriation of $514,215 to award fire assistance grants. Fire departments eligible to apply may receive grant funding up to $1,500 for the purchase of eligible wildland fire suppression equipment. Fire departments are required to equally match (50/50) the amount of the award. Grant funding is based on federal guidelines for use in fire districts serving a rural area or a rural community with a population of 10,000 or less. A fire department serving a population greater than 10,000 and not providing protection to a rural area or rural community is not eligible for VFA financial assistance.
Applications are scored based on established rating criteria including population, the I.S.O. Fire Prevention Insurance rating, the presence of Native American communities in the district and the date of the last VFA grant received.

Draft Intended Use Plans (IUPs) for Federal Fiscal Year 2019
The New York State Environmental Facilities Corporation (EFC), the Department of Environmental Conservation (DEC) and the Department of Health (DOH) are pleased to announce the availability of the Draft Federal Fiscal Year (FFY) 2019 Intended Use Plans (IUPs) for the Clean Water State Revolving Fund (CWSRF) and the Drinking Water State Revolving Fund (DWSRF). The CWSRF and DWSRF programs are available to municipalities and certain non-municipal entities in New York State to finance water quality and drinking water related projects.
The Draft IUPs include lists of projects that could receive financing between October 1, 2018 and September 30, 2019, the next IUP financing period.
EFC anticipates that it will be able to provide zero-percent interest rate or low-cost financing for $1.06 billion of project costs for the CWSRF during FFY 2019. This includes an estimated federal capitalization grant amount of $120 million.
DOH will receive an estimated $45 million DWSRF federal capitalization grant of which a maximum of $9 million may be made available as grants for certain eligible projects.
ELIGIBLE PROJECTS:
CWSRF - Municipal water pollution control projects eligible for CWSRF subsidized and market-rate financing under Section 212 of the Clean Water Act (CWA) include, but are not limited to: wastewater treatment facilities and conveyance systems; combined sewer overflow abatement facilities; stormwater pollution abatement; and other municipally-owned projects or portions of projects that maintain, protect or improve water quality.
Municipal and non-municipal entities may apply for CWSRF assistance for non-point source projects that protect water quality under CWA Section 319 or implement an approved National Estuary Plan under CWA Section 320. Projects eligible for CWSRF subsidized and market-rate financing at preferred rates include, but are not limited to: green infrastructure; water quality aspects of landfills such as landfill leachate collection, storage and treatment, and landfill capping; stormwater management facilities and equipment; wetland and waterbody restoration; deficient or failing decentralized septic systems; or other non-point source projects to maintain, protect or improve water quality under Section 319.
DWSRF - Municipally-owned and privately-owned community water systems and non-profit, non-community water systems may be eligible for DWSRF subsidized financing. Municipally-owned water systems that are not eligible for subsidized financing are eligible for market-rate financing at preferred rates. Projects eligible for DWSRF financing include: construction, rehabilitation, and upgrading of water treatment plants; transmission and distribution mains; storage facilities; pump stations; rehabilitation or development of new drinking water sources; consolidation of water supply services; and capital investments to improve security of drinking water systems.
INTENDED USE PLANS & PROJECT LISTING:
Eligible entities interested in financing one or more projects not listed in the Draft CWSRF IUP or Draft DWSRF IUP should submit the appropriate IUP project listing information as soon as possible but no later than Monday, August 27, 2018 as provided below. For assistance with the IUP listing process, please contact EFC.
For CWSRF projects, applicants must use the Project Listing and Update System (PLUS) available at https://plus.efc.ny.gov/plus/. An approvable engineering report or technical report, and a Smart Growth Assessment Form must be provided to EFC no later than Monday, August 27, 2018 for the project to appear on the Annual List of the Final CWSRF IUP.
For DWSRF projects, applicants must provide a DWSRF Listing Form and an engineering report or plans and specifications to DOH by Monday, August 27, 2018, or have completed construction, to be included on the Annual List in the Final DWSRF IUP.
A notice regarding the availability of the Draft IUPs will be e-mailed to municipal applicants, system owners, financial advisors, consulting firms, and other interested parties. The Draft CWSRF and DWSRF IUPs will also be available on the EFC website at www.efc.ny.gov.
WEBINAR:
EFC and DOH will host a webinar to review the Draft 2019 CWSRF and DWSRF IUPs on Wednesday, August 1, 2018 at 10:00 AM. This event will present an overview of the 2019 CWSRF and DWSRF IUPs, as well as provide an opportunity to answer participant questions. Log-on instructions for this webinar will be posted on EFC’s website at www.efc.ny.gov.
PUBLIC MEETING & HEARING:
A joint public meeting and hearing to review the Draft 2019 CWSRF IUP and DWSRF IUP and to accept public comments on the IUPs will be held on Thursday, August 9, 2018 at 2:00 PM at NYSDEC, 625 Broadway, Public Assembly Room 129, Albany, NY 12207.
Pre-registration is not required.
The public hearing has been scheduled at a place reasonably accessible to persons with a mobility impairment. Interpreter services will be made available to hearing impaired persons, at no charge, upon written request submitted within a reasonable time prior to the scheduled public hearing. The written request must be addressed to the EFC representative designated below.

Developers seeking financing for new construction, substantial rehabilitation and moderate rehabilitation of site-specific, affordable, multi-family rental housing.
New York State Homes and Community Renewal (“HCR”) announces the availability of approximately $697,300,000 of funding under its 2018 Multifamily Open Window Request for Proposals (“RFP”). Fiscal Year 2018-19 funding for the Open Window application process is being made available for the following programs: up to $130,000,000 for the New Construction Capital Program (“NCP”); up to $200,000,000 for the Supportive Housing Opportunity Program (“SHOP”); up to $50,000,000 for the Senior Housing Program; up to $40,000,000 for the Middle Income Housing Program (“MIHP”); up to $21,800,000 for the Federal Housing Trust Fund program (“Federal HTF”); up to $46,000,000 for the Public Housing Preservation Program (“PHP”); up to $38,000,000 for the Multifamily Preservation Program (“MPP”); up to $86,000,000 for the Mitchell-Lama Program; up to $30,000,000 for the Homes for Working Families program (“HWF”); up to $5,500,000 in annual allocations of State Low Income Housing Credit (“SLIHC”); up to $30,000,000 for the Rural and Urban Community Investment Fund (“CIF”); and up to $20,000,000 for the Small Building Participation Loan Program. This funding is made available through the New York State Division of Housing and Community Renewal (“DHCR”), the Housing Trust Fund Corporation (“HTFC”), and the New York State Housing Finance Agency (“HFA”).
This RFP for site-specific multi-family project applications seeking funding under these programs was made available on June 20, 2018. This RFP also explains how HCR may offer a limited amount of Project Based Voucher (“PBV”) assistance, depending upon availability, for proposed projects seeking the financing allocated under this competitive Request for Proposals.
Applications requesting funding under this RFP may be submitted at any time until all allocations of resources are committed. It is anticipated that an RFP will be issued in the spring of 2019 for Fiscal Year 2019-20 funding.
Applications will be reviewed as received and funding determinations will be made throughout the year. Applications seeking consideration for PBV assistance in combination with eligible funding will be evaluated at the end of each month.
This Notice of Credit and Funding Availability (“Notice”) describes the programmatic and submission requirements for the listed programs.
Applicants may only apply under this Notice for awards for new construction, substantial rehabilitation and moderate rehabilitation of site-specific multi-family rental housing Projects that (i) will also have first mortgages financed by tax-exempt or taxable Private Activity Bonds (“Bonds”) issued by HFA or (ii) are eligible to apply for “stand alone” funding without tax-exempt bonds or 9% tax credits. Any awards made under this Notice will be contingent on the Project receiving an award of Bond volume cap authority sufficient to fund the Project’s first mortgage, as applicable.
HCR is making available a variety of financing options and programs through this single, “Open Window” Notice to encourage, in a manner that ensures its quality and affordability, a wide range of affordable housing including new construction, adaptive reuse of non-residential buildings, and preservation of existing housing. The core mission of this funding availability is to provide financing and capital to promote affordable rental housing opportunities for low- to moderate- income residents of New York State.
The manner in which these financing resources are being deployed provides flexibility for developers and the agencies to consider different potential financing options for projects simultaneously.
HCR will allocate these resources to provide for the market and site-specific needs and opportunities within the diverse communities and neighborhoods across New York State, including urban, suburban and rural areas. Therefore, we encourage a range of project goals that are responsive to the particular needs of a location or population including: coordinated investments that take into account other activities in the community, mixed income and mixed use developments, and integrated, supportive housing to meet the needs of a variety of special populations.
In addition to the creation and preservation of affordable housing, HCR works to promote community and economic development. We encourage coordination with municipalities and other state agencies so that projects are a part of the transformation and revitalization of communities. As a result, the development and preservation of housing can accomplish more than affordable housing.
HCR’s overall priority is to encourage the submission of applications that will support and promote high quality projects that address the needs of individuals, families and seniors, and that may advance one or more of the specific housing priorities of New York State as described in the RFP.
This Notice explains the process by which HCR will accept and evaluate applications requesting these resources. This process is explained in more detail in the RFP. After a determination has been made, unsuccessful Applicants may request an exit conference with HCR staff to review their application.
Prospective Applicants may request technical assistance in preparing an application at any time.
HCR retains the right to waive any requirement contained in the RFP, subject to the applicable statutes and program regulations, as well as to terminate or revise the RFP from time to time. HCR reserves the right to award all, a portion of, or none of the program funds, SLIHC, or PBV based upon funding availability, readiness, feasibility of the Projects, the Applicant’s ability to meet HCR criteria for funding, and the Applicant’s ability to advance the State’s housing goals. HCR also reserves the right to review applications requesting program funds, SLIHC, or PBV as applications for funding under other programs for which the Project may be eligible through HCR, and to change or disallow aspects of the applications received. HCR reserves the right to make any such changes as an express condition of its award commitment for the Project.
HCR will seek to award these limited resources so as to promote a statewide geographic distribution of such financing. Therefore, awards for proposed Projects may be denied in areas of the State that have recently been awarded HCR capital financing. Funding may also be denied to Projects where market studies or other analyses indicate low-income housing saturation.
Pre-application Requirements
Prospective Applicants are required to schedule and coordinate a pre-application meeting with development team members and HCR staff. The pre-application meeting will enable HCR to assess Project readiness and determine whether it is appropriate for the Applicant to proceed with submission of an application for any program included in this notice. Should an Applicant submit an application to HCR without previously conducting such a meeting, HCR reserves the right, in its full discretion, to terminate the application without further review.
