Transfer of Property with an Original Cost of Less Than $100,000
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering whether to provide its written consent, pursuant to Public Service Law (PSL) Section 70 for a proposed transfer of property from Orange and Rockland Utilities, Inc. to the Town of Goshen.
Statutory authority:
Public Service Law, section 70(1)
Subject:
Transfer of property with an original cost of less than $100,000.
Purpose:
To determine wither the to provide written consent, pursuant to Public Service Law section 70, for the proposed transfer of property.
Substance of proposed rule:
On February 26, 2013, Orange and Rockland Utilities, Inc (O&R) filed a notification, pursuant to Public Service Law (PSL) Section 70 of a proposed transfer of property by O&R to the Town of Goshen (Town). As a part of securing necessary approvals from the Town for the construction of O&R’s Hartley Road Substation, O&R proposes to grant the Town a conservation easement over 28.74 acres of property and transfer.647 acres of land along the frontage of Hartley Road and.22 acres of property along Cheechunk Road to the Town in fee simple. O&R states that value of the easement and the property that would be transferred in fee simple has been appraised at $48,000. O&R also states that the easement and transfer of property would be at no cost to the Town. As the proposed transfers have an original value of less than $100,000, PSL Section 70(1) provides that O&R may proceed with the transaction 90 days after providing notification to the Commission, unless the Commission determines within that 90 days that the public interest requires the Commission’s review and written consent before the transfer can occur. The Commission is considering whether the public interest requires its review and written consent for the proposed transfer. Furthermore, the Commission is considering whether to provide its written consent to the transfer on the terms specified in O&R’s notification, or predicated on different terms, or to withhold its written consent. The Commission may also address related matters and may apply its decision here to other utilities.
