Consideration of a Proposal to Allow Customers to Combine Certain Economic Development Electric Supply and Delivery Discounts
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a New York Power Authority's proposal to allow customers to combine their awarded Preservation Power, Replacement Power or Expansion Power low-cost supply allocation with their Zone or Excelsior Jobs delivery discount.
Statutory authority:
Public Service Law, sections 4(1), 65 and 66
Subject:
Consideration of a proposal to allow customers to combine certain economic development electric supply and delivery discounts.
Purpose:
To allow customers to receive the benefit of both supply discounts and unrelated delivery discounts on the same electric load.
Substance of proposed rule:
On February 11, 2013, The New York Power Authority (NYPA), submitted comments in Case 11-E-0176 on the Commission’s consideration of a petition seeking to combine certain electric delivery and supply discounts on the same electric load. NYPA’s comments requested that the Commission allow customers that were eligible for other NYPA economic development supply discounts to be allowed to also supply their delivery discounts on that same electric load. Some of the programs involved in NYPA’s request were different than those under consideration by the Commission in Case 11-E-0176. On March 18, 2013, the Commission instituted a new proceeding, Case 13-E-0109 to consider NYPA’s request. The Commission is considering whether to approve, reject or modify, in whole or in part, the relief requested in NYPA’s comments.
