Rehearing of a Gas Transportation Rate
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition for rehearing filed by Alliance Energy Transmissions LLC and Seneca Power Partners LLC requesting rehearing of the gas transportation rate set in an Order issued February 15, 2013.
Statutory authority:
Public Service Law, sections 66(1), (2), (3), (5), (8), (9), (10), (12) and 72
Subject:
Rehearing of a gas transportation rate.
Purpose:
Consideration of rehearing of a gas transportation rate.
Substance of proposed rule:
The Public Service Commission is considering a petition for rehearing filed on March 18, 2013 by Alliance Energy Transmissions LLC and Seneca Power Partners LLC requesting rehearing of the Order Determining Gas Transportation Rate issued February 15, 2013 on the grounds that the most recent property tax billings and a return on investment based on valuation of 11.2 miles of 8-inch steel gas pipeline were not used in setting a gas transportation rate. The Commission may adopt, reject or modify, in whole or in part, the relief proposed and may resolve related matters.
