In the Matter of Considering the Adoption of an Agency Specific Short Environmental Assessment Form related to the Agricultural Districts Program (Agriculture and Markets Law Article 25-AA), pursuant to Article 8 of the Environmental Conservation Law and Section 617.14 of the New York State Official Compilation of Codes, Rules and Regulations.
PLEASE TAKE NOTICE that a public hearing will be held before a person designated by the Commissioner of Agriculture and Markets on December 7, 2020 at 10:00 a.m., and concluding when all interested parties have been heard to receive comments to consider the adoption of an agency specific short Environmental Assessment Form (EAF) related to Agricultural Districts Program, as described in Article 25-AA of the Agriculture and Markets Law (AML).

PLEASE TAKE FURTHER NOTICE, that the Commissioner provides this notice and opportunity for a hearing pursuant to Environmental Conservation Law Article 8, and Part 617.14(a) of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (NYCRR), which states, in relevant part, a requirement that “all agencies to adopt and publish, after public hearing, any additional procedures that may be necessary for them to implement SEQR.”
PLEASE TAKE FURTHER NOTICE, that the proposed short EAF form is being adopted for use in review of actions designated as an “Unlisted Action” pursuant to the State Environmental Quality Review Act (SEQRA), and which involve the modification of an existing Agricultural District, which includes the termination or modification of such district, pursuant to AML section 303-a; the inclusion of viable agricultural land to an existing Agricultural District, pursuant to AML section 303-b; and/or the consolidation of existing Agricultural Districts, pursuant to AML section 303-c.

Pursuant to 42 CFR Section 447.205, the Department of Health hereby gives public notice of the following:
The Department of Health (DOH) proposes to amend the Office for People With Developmental Disabilities (OPWDD) 1915(c) Comprehensive Home and Community-Based Services (HCBS) Waiver (NY.0238) effective April 1, 2021. Proposed changes are being made to permanently adopt certain provisions that were temporarily adopted to address the COVID-19 public health emergency and change the implementation dates for certain rate setting commitments.
The amendment proposes to revise the service description for Community Habilitation to allow the delivery of Community Habilitation services within certified residences and allow certain services to be delivered via telehealth modalities. Consistent with the temporary COVID-19 public health emergency provisions, the proposed amendment includes the allowance of telehealth service delivery for Day Habilitation, Prevocational Services, Respite, Pathway to Employment, Support Brokerage, Community Habilitation, and Supported Employment. The use of telehealth modalities after the COVID-19 public health emergency may be contingent upon other state and federal actions in addition to this amendment to the OPWDD Comprehensive HCBS Waiver.
Changes are proposed to the Intensive Respite service definition to allow individuals who live in certified settings to access Intensive Respite from a Crisis Services for Individuals with Intellectual and/or Developmental Disabilities (CSIDD) Resource Center. This action is limited to resource center services to address the crisis needs of the individual living in a certified residence who is receiving the CSIDD service. During the person’s stay, the certified residence is eligible to bill reserve days similar to provisions that are currently in place when a resident is hospitalized.
In addition, OPWDD is proposing to change the July 1, 2021 implementation date of a new overnight Respite reimbursement methodology and use of the Coordinated Assessment System (CAS) to determine Higher-Needs Funding and Personal Resource Account (PRA) calculations from July 1, 2021 to October 1, 2021.
The estimated annual net aggregate increase in gross Medicaid expenditures attributable to the provision of Intensive Respite for CSIDD participants who reside in an OPWDD certified residence is approximately $885,000. This additional Medicaid cost will reduce non-federal costs for this service. It is also anticipated that this investment will reduce costs associated with crisis-related institutional stays. The other actions included in this amendment will not increase Medicaid expenditures.
The public is invited to review and comment on the proposed April 1, 2021 HCBS Waiver Amendment beginning November 10, 2020 through December 18, 2020. The proposed amendment will be available for public review on the OPWDD website at: https://opwdd.ny.gov/providers/home-and-community-based-services-waiver and local OPWDD Developmental Disabilities Regional Offices (DDROs) as of November 10, 2020. Individuals without Internet access may view the proposed Amendment at any local (county) social services district.

In F-2020-0868, the Port Authority of New York and New Jersey is proposing the LaGuardia Airport Access Improvements Project within portions of the Flushing Bay/Flushing Creek, in the Borough of Queens, Queens County, New York. The proposed action would be located on properties owned by New York City and New York State.
The proposed action includes the following components:
• An aboveground, elevated fixed guideway AirTrain system with three AirTrain stations connecting the Airport to the NYCT Subway 7 Line and the Port Washington Branch of the LIRR commuter rail. The AirTrain system would include:
o Passenger walkway systems connecting the AirTrain stations to passenger terminals, parking garages, public transportation and ground transportation facilities;
o Connections to the Airport Central Hall, Airport parking garage connector and existing subway and LIRR stations to support the AirTrain walkway system connections, including elevators, escalators, and stairs to garage levels, terminals, and mass transit;
o An AirTrain operations, maintenance, and storage facility (OMSF);
o Three traction power substations to provide electrical power to the AirTrain system;
• Parking for Airport, AirTrain and MTA employees, as well as replacement Citi Field parking, located at the OMSF.
• Utilities infrastructure, both new and modified to support the Proposed Action.
• A new ConEdison 27-kilovolt electrical industrial station located adjacent to the OMSF.
• Acquisitions of temporary and permanent easements on portions of certain parcels to facilitate construction of the Proposed Action; and
• Connected actions to allow construction of the Proposed Action including;
o Temporary MTA bus storage/parking facility during construction of the OMSF;
o Relocation of up to 200 Citi Field parking spaces temporarily displaced during construction;
o Passerelle Bridge replacement to accommodate the proposed off-Airport AirTrain station;
o Operational improvements to the Mets-Willets point LIRR Station (new shuttle service) and supporting physical improvements; and
o Relocation of World’s Fair Marina facilities to accommodate the proposed AirTrain guideway.
The proposed Action will not affect or change any airfield components; including the runways, taxiways or aircraft arrival and departure procedures.

Department of State Notice of Review for the City of Tonawanda Draft Local Waterfront Revitalization Program Amendment
In accordance with the New York State Waterfront Revitalization of Coastal Areas and Inland Waterways Act and the New York State Coastal Management Program, the City of Tonawanda, located within Erie County, has prepared a Draft Local Waterfront Revitalization Program (LWRP) Amendment. The LWRP is a comprehensive management program for the City’s waterfront resources along the Niagara River, Tonawanda Creek/Erie Canal, Two Mile Creek and Ellicott Creek.
To approve the City of Tonawanda LWRP Amendment, pursuant to Article 42 of the NYS Executive Law, it is required that potentially affected State, federal, and local agencies be consulted to assure that the program does not conflict with existing policies and programs. For this purpose, the Draft LWRP Amendment is available online at: http://www.dos.ny.gov/opd/programs/WFRevitalization/LWRP_draft.html
The City of Tonawanda Draft LWRP Amendment was accepted by the New York State Department of State (DOS) as complete and is now available for review by potentially affected State, federal and local agencies, and the public. Comments on the Draft LWRP Amendment are due by January 11, 2021. At the close of this required review period, DOS will coordinate responses to comments received with the City, and revisions to the LWRP Amendment will be made as necessary to address all comments. Following adoption of the LWRP by the City, and its subsequent approval by the Secretary of State, pursuant to 15 CFR Part 923, Subpart H, DOS will request incorporation of the LWRP Amendment into the State’s Coastal Management Program by the federal Office for Coastal Management (OCM), as a Program Change.
