Appeal of DPS' Application of NFGD's 2014 Audit
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On 7/13/17, the PSC adopted an order approving in part and denying in part, National Fuel Gas Distribution Corporation's (NFGD) appeal of the Department of Public Service's application of the Gas Safety Metrics in NFGD's 2014 Records and Field Audits.

Public Service Law, sections 65 and 66
Subject:
Appeal of DPS' application of NFGD's 2014 Audit.
Purpose:
To approve in part and deny in part, NFGD's appeal of DPS' application of NFGD's 2014 Audit.
Substance of final rule:
The Commission, on July 13, 2017, adopted an order approving in part and denying in part, National Fuel Gas Distribution Corporation's (NFGD) appeal of the Department of Public Service's (DPS) application of the Gas Safety Metrics in NFGD's 2014 Records and Field Audits. NFGD’s appeal is granted with respect to 16 NYCRR § 255.726, the negative revenue adjustment for which shall be removed and due to removal of the violation of 16 NYCRR § 255.726, NFGD shall be assessed a negative revenue adjustment of $130,000 for violations identified in the Records and Field Audits performed in 2014. NFGD’s appeal is denied with respect the Company’s request to remove negative revenue adjustment assessments for audit citations of 16 NYCRR §§ 255.739(a), 255.813(c), and 255.819(a). NFGD’s appeal is also denied with respect to the request that changes be made to the Gas Safety Performance Measures Report filed on June 15, 2016, subject to the terms and conditions set forth in the order.
