Pursuant to 42 CFR Section 447.205, the Department of Health hereby gives public notice of the following:
The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for long term care services to comply with proposed statutory provisions. The following significant changes are proposed:
Long Term Care Services
Effective on or after December 1, 2013, additional payments shall be made to state government operated public residential health care facilities, in aggregate amounts of up to $30 million. The amount allocated to each eligible governmental RHCF will be in based on each eligible state operated governmental nursing home’s upper payment limit margin. Payments to eligible RHCF’s may be added to rates of payment or made as aggregate payments.
The estimated annual net aggregate increase in gross Medicaid expenditures attributable to this initiative is $30 million.
The public is invited to review and comment on this proposed State Plan Amendment. Copies of which will be available for public review on the Department’s website at http://www.health.ny.gov/regulations/state_plans/status.
Copies of the proposed State Plan Amendments will be on file in each local (county) social services district and available for public review.

On July 15, 1997, New York State’s Medicaid demonstration program, The Partnership Plan, was approved by the Federal government under Section 1115 of the Social Security Act. This waiver has been extended and amended to reflect programmatic needs. Under the waiver, the State is required to seek Federal approval of any amendments.
The New York State Department of Health (NYSDOH) is seeking approval from the Federal Centers for Medicare & Medicaid Services (CMS) for the following changes:
• The Department will be submitting a Behavioral Health (BH) amendment to the Centers for Medicare and Medicaid Services in December 2013 in order to describe BH transition from a fee for service payment and delivery model to services under Medicaid Managed Care.
• BH State Plan Services and new Home and Community Based Services will be added to the Medicaid Managed Care Scope of Benefits.
• New Managed Care lines of business called Health and Recovery Plans (HARPs) will be established for individuals with significant mental health and substance use disorders.
• Implementation target dates are January 2015 for adults in NYC, July 2015 for adults in the rest of the State and January 2016 for children.

Susquehanna River Basin Commission
SUMMARY: The Susquehanna River Basin Commission will hold its regular business meeting on December 12, 2013, in Annapolis, Maryland. Details concerning the matters to be addressed at the business meeting are contained in the Supplementary Information section of this notice.

Opportunity to Appear and Comment:

As identified in the public hearing notice referenced below, written comments on the Regulatory Program projects that were the subject of the public hearing, and are listed for action at the business meeting, are subject to a comment deadline of November 25, 2013. The 2013 update of the Comprehensive Plan listed for Commission action was the subject of a public hearing conducted by the Commission on August 15, 2013, and as identified in the notice for such hearing, which was published in 78 FR 38782, June 27, 2013, was subject to a comment deadline of August 26, 2013. Written comments pertaining to any other matters listed for action at the business meeting may be mailed to the Susquehanna River Basin Commission, 4423 North Front Street, Harrisburg, PA 17110-1788, or submitted electronically through http://www.srbc.net/pubinfo/publicparticipation.htm. SUPPLEMENTARY INFORMATION: The business meeting will include actions or presentations on the following items: (1) informational presentation of general interest on the lower Susquehanna River; (2) resolution concerning FY-2015 Federal funding of the Susquehanna Flood Forecast and Warning System and National Streamflow Information Program; (3) 2013 update of the Comprehensive Plan for the Water Resources of the Susquehanna River; (4) sale of the former headquarters property at 1721 North Front Street, Harrisburg, PA; (5) ratification/approval of contracts/grants; and (6) Regulatory Program projects. Projects listed for Commission action are those that were the subject of a public hearing conducted by the Commission on November 13, 2013, and identified in the notice for such hearing, which was published in 78 FR 64260, October 28, 2013.
