I.D No. PSC-05-18-00008-P
Implementation of Advanced Metering Infrastructure (AMI) in O&R's Territory, and Provisions for Individual Opt-Outs Therefrom
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition for rehearing filed by Deborah Kopald on December 18, 2017.
Statutory authority:
Public Service Law, sections 2, 5(1), (2), 22, 53, 65(1), (2), (3), 66(1), (2), (3), (5), (8), (9) and (12)
Subject:
Implementation of Advanced Metering Infrastructure (AMI) in O&R's territory, and provisions for individual opt-outs therefrom.
Purpose:
To consider Advanced Metering Infrastructure (AMI) in Orange and Rockland's service territory.
Substance of proposed rule:
The Commission is considering a petition for rehearing (Petition), filed by Deborah Kopald on December 18, 2017, of an Order (Order) Granting, in Part, and Denying, in Part, the Petition of Orange and Rockland Utilities, Inc. (O&R) for Authorization of a Program Advancement Proposal, issued November 16, 2017 in this proceeding. The petition alleges that the order erred as a matter of law and fact pursuant to 16 NYCRR § 3.7(b). In the petition, Ms. Kopald objects to the implementation of Advanced Metering Infrastructure (AMI) in O&R’s service territory. Specifically, Ms. Kopald argues that the Commission’s Order required that an evidentiary hearing be held, because the order constituted a major rate change as that term is defined in Public Service Law (PSL) § 89-c(10). The full text of the petition may be reviewed online at the Department of Public Service web page: www.dps.ny.gov. Upon conducting its evaluation of the petition, the Commission may reaffirm its initial decision or adhere to it with additional rationale in denying the request, modify or reverse the decision in granting the request in whole or in part, or take such other or further action as it deems necessary with respect to the request. However, the Commission will limit its review to the issues raised by the above-referenced request.
