System Improvement Tracker Implementation
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a tariff revision filed by National Fuel Gas Distribution Corporation to implement a system improvement tracker to recover leak prone pipe costs incurred between April 1, 2023 and September 30, 2024 and other deferred costs.
Statutory authority:
Public Service Law, sections 4 and 66
Subject:
System improvement tracker implementation.
Purpose:
To determine whether to implement the system improvement tracker.
Substance of proposed rule:
The Public Service Commission (Commission) is considering a tariff revision filed by National Fuel Gas Distribution Corporation (National Fuel or the Company) on December 9, 2022 requesting to implement a system improvement tracker (SIT) to recover qualified leak prone pipe (LPP) costs the Company incurred from April 1, 2023 through September 30, 2024, and to recover deferred LPP costs associated with its existing System Modernization Tracker (SMT).
In its filing, National Fuel states that the Company would agree to a “stay-out” provision under which it would not file a new base rate case before October 2023, with a rate year commencing October 1, 2024, if the Commission authorizes the implementation of the SIT surcharge. National Fuel also states the implementation of the SIT surcharge is in the public interest as customers would be spared the expense of a full rate case and the Company’s current base rates would continue without an increase until October 1, 2024. The SIT surcharge would also permit the Company to recover a portion of the SMT regulatory asset. In addition, the Company reiterates that the implementation of the SIT surcharge would provide National Fuel an incentive to continue the replacement of LPP, which aligns with significant safety and environmental policy goals of the Commission, the Company, and the State of New York.
