The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for non-institutional services to comply with enacted statutory provisions. The following changes are proposed:
Non-Institutional Services
Effective on or after April 1, 2018, the Early Intervention Program will amend the Medicaid State Plan to move Early Intervention Services from the Rehabilitative section of the State Plan to the Early and Periodic Screening, Diagnostic and Treatment Services (EPSDT) section. This change is to comport with guidance received from the Centers for Medicare and Medicaid Services (CMS) through the Office of Health Insurance Programs. In addition, New York State licensed applied behavior analysts will be added as of early intervention service providers.
There is no additional estimated annual change to gross Medicaid expenditures as a result of the proposed change.
The public is invited to review and comment on this proposed State Plan Amendment, a copy of which will be available for public review on the Department’s website at http://www.health.ny.gov/regulations/state_plans/status. The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for non-institutional services to revise provisions of the Ambulatory Patient Group (APG) reimbursement methodology. The following change is proposed:
Non-Institutional Services
The following is a clarification to the December 27, 2017 noticed provision for the adjustment of the Article 16 APG rates intended to take into account increased labor costs resulting from statutorily required increases in the New York State minimum wage. Under the statute, increases in the minimum wage will be phased in over a number of years until the minimum wage is $15 per hour for the New York City (large and small employers) and Nassau, Suffolk and Westchester counties. The remainder of the State increases in the minimum wage will be phased in over a number of years until the minimum wage is $12.50 per hour.
The is no additional estimated annual change to gross Medicaid expenditures as a result of the proposed Article 16 APG reimbursement clarification.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activities comply with and will be conducted in a manner consistent to the maximum extent practicable with the federally approved New York State Coastal Management Program (NYSCMP). The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue, in Albany, New York.
In F-2018-0054, the applicant, Ole Jule Dredge Company, LLC, is proposing to dredge the bottom of a portion of the James Creek fronting several (3-4) private waterfront properties in Mattituck, Town of Southold, County of Suffolk, New York. The activity is proposed as maintenance dredging to -4 feet at mean low water and is proposed to improve or maintain sufficient depth for clear navigational access for the recreational watercraft at existing private docks along this section. A maximum volume of 1,200 cubic yards of material is proposed to be removed and temporarily stored on the upland. Two areas of the upland adjacent to the creek, situated on private residential parcels at 1700 and 1780 Jule Lane, are designated areas to receive the dredge spoils for the purpose of dewatering and until spoils are ready to be transported to an approved upland facility. Silt curtains would be installed around these areas to retain dredged materials during work and until spoils are removed. Water from the dewatering process would be directed and allowed outlet back into the creek through a conduit and rip rap apron.
Dredging will be performed by crane and excavator and the creek will be accessed primarily from the land side. A barge-mounted crane may be used for the most difficult to reach locations. According to the information submitted to the Department of State, the bottom is stated to be owned by Suffolk County. These activities may be within the jurisdiction of the Southold Town Trustees and subject to further local permitting and standards.
The above-referenced project is located within the Town of Southold Local Waterfront Revitalization Program (LWRP) planning area and proposed activities are subject to evaluation under the policies and purposes of the federally approved program.

Department of State F-2018-0140 Date of Issuance – April 11, 2018

The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program.
In F-2018-0140, Mr. Alan Stange, is proposing the Stange Bulkhead Repair Project at 23 Triple Oak Lane, in the Village of Nissequogue, Suffolk County. The existing bulkhead and beach access were destroyed in a series of nor’easters during 2018, and the bluff face has retreated approximately 15 feet landward. The applicant proposes (a) reconstructing 213 linear feet of bulkhead at the existing toe of the bluff, (b) constructing a 220-linear foot secondary wall approximately 12 feet landward of the reconstructed bulkhead; (c) replenishing the eroded bluff material; (d) placing armor stone for wave and scour protection seaward of the secondary wall; (e) replanting the bluff face with native grass, brush and shrubs; and (f) reconstructing the timber stairs and platform over the bluff and aluminum stairs to the beach. The activity currently under review proposes 63.5 cubic yards of sand, 58.0 cubic yards of sand-filled gabion baskets, and 33.1 cubic yards of armor stone below the spring high water elevation.
