Pursuant to 42 CFR Section 447.205, the Department of Health hereby gives public notice of the following:
The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for non-institutional services to comply with enacted statutory provisions. The following changes are proposed:
Non-Institutional Services
This notice clarifies the notice previously published on April 25, 2018 to apply Medicare Maximization to Article 28 claims for Traumatic Brain Injury (TBI) waiver population.
The estimated annual net aggregate increase in gross Medicaid expenditures attributable to this initiative contained in the budget for state fiscal year 2018/2019 is $1.0 million.
The public is invited to review and comment on this proposed State Plan Amendment, a copy of which will be available for public review on the Department’s website at http://www.health.ny.gov/regulations/state_plans/status. Individuals without Internet access may view the State Plan Amendments at any local (county) social services district.

The New York State Department of Health is submitting a request to the federal Centers for Medicare and Medicaid Services (CMS) to amend the Medicaid Redesign Team (MRT) Plan.
Pursuant to New York’s fiscal year 2019 enacted State budget, New York is seeking approval with this demonstration amendment to:
• Limit the nursing home benefit in the partially capitated Managed Long Term Care (MLTC) Plans: for a person who is permanently placed in a nursing home for a consecutive period of three months or more. In implementing this provision, the department shall continue to support service delivery and outcomes that result in community living for enrollees. Public Health Law 4403-f(v)(13)
• Limit plan to plan transitions within a 12-month period as follows: If another long term care plan certified under this section is available, medical assistance recipients required to enroll in such plans pursuant to this section, including recipients who have been assigned to a provider by the commissioner, may change plans without cause within ninety days of either notification of enrollment or the effective date of enrollment into a plan, whichever is later, by submitting a request of the entity designated by the department in a format to be determined by the department. In accordance with federal statutes and regulations, after such ninety-day period, the department may prohibit a recipient from changing plans more frequently than once every twelve months, except for good cause. Good cause may include poor quality of care, lack of access to covered services, lack of access to providers experienced in dealing with the enrollee’s care needs, or as otherwise determined by the commissioner. These changes do not impact the Medicaid Managed Care Plans or the integrated MLTC Plan products (Fully Integrated Dual Alignment – FIDA; Medicaid Advantage Plan – MAP; and Program of All-Inclusive Care for the Elderly – PACE) or their enrollees.

The New York City Deferred Compensation Plan & NYCE IRA (the “Plan”) is seeking proposals from qualified vendors to provide unbundled recordkeeping services for the City of New York Deferred Compensation Plan. The Request for Proposals (“RFP”) will be available beginning on Thursday, June 7, 2018. Responses are due no later than 4:30 p.m. Eastern Time on Tuesday, July 17, 2018.
