In the Matter of Considering Adoption of Part 207 of Title One of the Official Compilation of Codes, Rules, and Regulations of the State of New York, to be entitled “New York State Grape Research and Development Program”
TO WHOM IT MAY CONCERN:
PLEASE TAKE NOTICE that public hearings will be held, on the following dates and at the following locations, at which the President of the Urban Development Corporation (“President”), in consultation with the Commissioner of Agriculture and Markets (“Commissioner”), will consider, pursuant to section 6266-y of the Unconsolidated Laws of the State of New York, whether a referendum should be held to determine whether certain grape growers located in New York (“grape growers”) approve the adoption of the “New York State Grape Research and Development Program” (“GRDP”), to be placed in Part 207 of Title One of the Official Compilation of Codes, Rules, and Regulations of the State of New York (“1 NYCRR”). If the President, in consultation with the Commissioner, decides to hold a referendum, the GRDP shall be deemed approved and the President may thereafter adopt the GRDP if growers approve by a margin that meets any of the standards set forth in section 6266-y(3)(b) of the Unconsolidated Laws of the State of New York.
PLEASE TAKE FURTHER NOTICE that the GRDP, if adopted, would require grape growers to pay into a fund, established pursuant to the GRDP, which the President could use to support research relevant to grape production, harvesting, processing, storage and marketing. A copy of the express terms of the GRDP may be obtained from Mr. Mark McMullen, Marketing Order Administrator, Division of Agricultural Development, New York State Department of Agriculture and Markets, 10B Airline Drive, Albany, New York 12235.

Deferred Compensation Board
Pursuant to the provisions of 9 NYCRR, Section 9003.2 authorized by Section 5 of the State Finance Law, the New York State Deferred Compensation Board, beginning June 14, 2017 is soliciting proposals from Financial Organizations to provide 1) Active Opportunistic Growth U.S. Equity and 2) Active Environmental, Social, and Governance (ESG) Global or U.S. Equity management services. The funds will represent two of the investment options under the Deferred Compensation Plan for Employees of the State of New York and Other Participating Public Jurisdictions, a plan meeting the requirements of Section 457 of the Internal Revenue Code and Section 5 of the State Finance Law, including all rules and regulations issued pursuant thereto. A copy of the request for proposal will be posted on Callan’s website (www.callan.com). All proposals must be received no later than the close of business on July 31, 2017.
Active Opportunistic Growth U.S. Equity Product Design: Managers that manage opportunistic or aggressive growth U.S. equity portfolios benchmarked to the Russell 1000 Growth, Russell 3000 Growth, or NASDAQ indices. Sector funds are not considered responsive to this RFP. Candidates should demonstrate a mid to large cap U.S. equity focus to their growth investing style. Products with a small cap stock focus will not be considered. Managers should demonstrate active management via high active share (preference for 80% or higher) and high tracking error (preference for at least 3%) relative to the index.
Active ESG Global and U.S. Equity Product Design:
- ESG global equity strategies using either the MSCI World or MSCI ACWI Index as their primary benchmark will be considered. Country, sector and/or small cap oriented strategies will not be considered. Portfolio construction is required to be in line with the relevant index and therefore exhibit a minimum of style or market capitalization drift.
- ESG U.S. equity strategies using the Russell 3000, Russell 1000 or S&P 500 as their primary benchmark will be considered. Strategies with an extreme style bias, sector focus or small cap orientation will not be considered.
The RFP process for both the Opportunistic Growth and ESG options is open to evaluating mutual funds, CIT’s, or other daily valued, daily liquid pooled vehicles that are funded and able to accept NYSDC participant assets. Separate accounts and unfunded commingled vehicles will not be considered for these RFPs.

The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for non-institutional services. The following changes are proposed:
Effective on or after October 1, 2017, the Commissioner of Health will amend the State Plan for Health Home services to reduce the per member per month (pmpm) “outreach” payment for members in the case finding group that have been assigned to a Health Home from $135 (pmpm) to a rate no less than $100. In addition, the billing cycles applicable to outreach will be modified, and may include limiting payments for outreach to two consecutive months and requiring a face-to-face meeting in the second month.

The New York State Department of Health is submitting a request to the federal Centers for Medicare and Medicaid Services (CMS) to amend New York State´s Medicaid Section 1115 Medicaid Redesign Team (MRT) Waiver.
Beginning no earlier than January 1, 2018, New York is seeking approval with this demonstration amendment to:
• Expand the 1115 benefit package to include those OPWDD Medicaid services targeted for individuals with intellectual and developmental disabilities not previously included in the waiver benefit package.
• Transition coverage under the Office for People with Development Disabilities (OPWDD) 1915(c) Comprehensive Home and Community Based Services (HCBS) waiver to the 1115 demonstration.
• Remove the exemption from mandatory enrollment into Medicaid Managed Care (MMC) for Medicaid eligible persons who have an intellectual and/or developmental disability (IDD) as defined in Mental Hygiene Law 1.03, unless the individual is otherwise excluded from enrollment, i.e., available comprehensive Third Party Health Insurance and/or Medicare. Individuals who have an intellectual and/or developmental disability under the demonstration who have access to Comprehensive Third Party Health Insurance or Medicare will remain in Fee For Service (FFS) Medicaid until these exclusions from MMC enrollment are removed.

The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for non-institutional services related to Health Homes. The following changes are proposed:
Effective on or after January 1, 2018 the Commissioner of Health, in consultation with the Commissioner of the Office for People With Developmental Disabilities (OPWDD), will amend the State Plan for Health Home services to prioritize and phase in the enrollment of individuals with intellectual and/or developmental disabilities (I/DD) into Health Homes. Proposed State Plan Amendments include amending the Health Home eligibility chronic condition criteria to include new qualifying intellectual and/or developmental disabilities and establishing per member, per month Health Home rates for I/DD members that are based on a needs assessment. The State will be seeking an enhanced federal match of 90% for the new I/DD qualifying Health Home chronic conditions.

Oneida-Herkimer Solid Waste Authority is soliciting proposals from administrative service agencies relating to trust service, administration and/or funding of a Deferred Compensation Plan for the employees of the Oneida-Herkimer Solid Waste Authority. Department of State Notice of Routine Program Change Town of Huron Local Waterfront Revitalization Program
PURSUANT to 15 CFR 923.84(b), the New York State Department of State (DOS) has submitted a routine program change to the federal Office of Coastal Management (OCM). The change to the New York State Coastal Management Program (CMP) covered by this request is the incorporation of the Town of Huron Local Waterfront Revitalization Program (LWRP) into the State's CMP.
A major component of the State's CMP is the provision that local governments be allowed to prepare Local Waterfront Revitalization Programs, which further detail and make geographically specific the State's coastal policies. Each LWRP is reviewed for consistency with the State's CMP and approved if it meets the guidelines established in the State CMP and Article 42 of the NYS Executive Law.
The Town of Huron LWRP is a long-term management program for the Town’s waterfront resources along Sodus Bay, Lake Ontario, East Bay, and Port Bay, prepared under the provisions of Article 42 of the Executive Law and its implementing regulations. The LWRP revises the inland alignment of the coastal boundary by incorporating land acquired for preservation purposes located south and west of Shaker Tract Road. The LWRP includes comprehensive text and graphics describing the existing land uses and controls in the Town of Huron, including the Building Law that was amended in 2011 to implement the New York State Uniform Fire Prevention and Building Code and its standards, the Septic Law that was amended in 2013 to supplement and expand the local requirements for septic system maintenance and upgrades, the Land Development Regulations and Public Works Requirements Law adopted in 2005 to replace the Subdivision Regulations adopted in 1969, the local Coastal Erosion Hazard Area Law adopted in 2002 to regulate new construction or placement of structures in order to ensure that they are located a safe distance from areas of active erosion and the impacts of coastal storms, the Dock and Moorings Law adopted in 2005 to regulate the placement, construction and use of docks, piers, boathouses, boat hoists, and other structures or moorings in public waterways, and the LWRP Consistency Review Law adopted in 2016 to establish the legal framework for the review of direct and indirect Town actions with the waterfront revitalization area covered by the LWRP.
The draft LWRP was circulated by the New York State Department of State to potentially affected State, federal, and regional agencies during a review period from April 23, 2014 to June 26, 2014. Following this review period, the Department of State coordinated responses to comments received with the Town of Huron, and revised the draft LWRP where necessary. The Town of Huron LWRP was adopted by resolution by the Town of Huron Town Board on April 18, 2016, and approved by the New York State Secretary of State on May 15, 2017, pursuant to the New York State Waterfront Revitalization of Coastal Areas and Inland Waterways Act (NYS Executive Law, Article 42).
