PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition filed by the New York State Conference of Mayors and Municipal Officials (NYCOM) requesting assistance with obtaining information on CLECs and ESCOs.
Statutory authority:

Subject:
Petition by NYCOM requesting assistance with obtaining information on CLECs and ESCOs.
Purpose:
To consider the petition by NYCOM requesting assistance with obtaining information on CLECs and ESCOs.
Substance of proposed rule:
The Commission is considering a petition filed by the New York State Conference of Mayors and Municipal Officials (NYCOM) requesting assistance with obtaining information on the competitive local exchange telephone companies (CLECs) and energy services companies (ESCOs) that sell electric and/or natural gas supply within individual municipal borders. With respect to CLECs, NYCOM seeks a requirement to notify local municipalities or the Commission (with that information made available to local municipalities) when a CLEC acquires at least one customer in a municipality. With respect to ESCOs, NYCOM is seeking information currently in the possession of the local distribution companies (LDCs) responsible for delivering gas and electric service. The Commission may adopt, reject, or modify, in whole or in part, the relief proposed and may resolve related matters.
