Approving the Transfer of Ownership and Operational Interests in the Danskammer Generation Facility
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On 6/26/14, the PSC adopted an order approving the petition by Helios Power Capital LLC (Helios) and others, the transfer of ownership interests in the Danskammer Generation Facility to Mercuria Energy America, Inc.
Statutory authority:
Public Service Law, sections 5(1)(b) and 70
Subject:
Approving the transfer of ownership and operational interests in the Danskammer Generation Facility.
Purpose:
To approve the transfer of ownership and operational interests in the Danskammer Generation Facility.
Substance of final rule:
The Commission, on June 26, 2014, adopted an order approving a petition by Helios Power Capital, LLC, Danskammer Energy, LLC and Mercuria Energy America, Inc. (Mercuria) to transfer ownership and operational interests in the Danskammer Generation Facility located in the Town of Newburgh and granted Mercuria as the controlling indirect owner of the facility, to operate it under lightened regulation, subject to the terms and conditions set forth in the order.
