Pursuant to Section 176-b of the Town Law, the Office of Fire Prevention and Control hereby gives notice of the following:
Application for Waiver of the Limitation on Non-resident Members of Volunteer Fire Companies
An application for a waiver of the requirements of paragraph a of subdivision 7 of section 176-b of the Town Law, which limits the membership of volunteer fire companies to forty-five per centum of the actual membership of the fire company, has been submitted by the Forks Fire District No. 3 Town of Cheektowaga, County of Erie.
Pursuant to section 176-b of the Town Law, the non-resident membership limit shall be waived provided that no adjacent fire department objects within sixty days of the publication of this notice.
Objections shall be made in writing, setting forth the reasons such waiver should not be granted, and shall be submitted to:

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activities comply with and will be conducted in a manner consistent to the maximum extent practicable with the federally approved New York State Coastal Management Program (NYSCMP). The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue, in Albany, New York.
In F-2018-0149, the applicant, Extell Hudson River Waterfront Development, LLC, proposes to construct a mixed-use redevelopment of an underutilized waterfront site along the eastern shoreline of the Hudson River in the City of Yonkers, Westchester County, NY. The Extell Waterfront Development site (“the Project site”) is located at 42 Water Grant Street, Yonkers. The Project entails the redevelopment of the former “BICC” and “Excelsior Bag” sites, encompassing 21.54 acres, on Alexander Street and anticipates creation of a new waterfront neighborhood with amenities serving the Yonkers community. The site is currently vacant except for the presence of a single 29,700 square foot structure (the former “EPRI building and known as the “EPRI slab”) historically utilized as a research facility for the electric industry. The building will be removed and the slab is proposed to remain with the surface to be improved as a new public space with accessways from a new waterfront esplanade. Proponents of the development project advance that the Project is consistent with goals set forth in the 2008 City of Yonkers Alexander Street Urban Renewal Plan and the Alexander Street Master Plan.
The larger upland development proposes approximately 1,378 units of rental housing, 52,000 square feet of retail space, and 1,383 parking spaces with construction of six (6) seven-story buildings and (1) twenty-story building. In accordance with City of Yonkers requirements, 10% of the units in each building will be designed as affordable housing.
The Project significantly includes waterfront plans to construct 2,825 feet of publicly accessible esplanade which would also serve as an emergency access route. The esplanade would be supported partially over the open waters of the Hudson River with 308 concrete piles. Additional features, proposed over water or tidal mudflat areas, include two public accessways and gangways to the EPRI slab which, as it exists, occupies over water space, and a new Building A, pile supported structure. Building A would overhang a tidally influenced mudflat which was created during remedial activities associated with former brownfield cleanup activities. The total proposed area of over-water or over-tidal mudflat features encompasses 54,067 square feet of space. This section of the Hudson River is a state-designated Significant Coastal Fish and Wildlife Habitat (SCFWH) – the Lower Hudson Reach.
Further Project elements include repair of 1,965 linear feet of rip rap shoreline with an elevation of the shoreline to +10.0 feet. No rip rap is proposed below spring high water; planting of the rip rap with native species; installation of (6) stormwater outfalls with separate stormwater collection systems; and installation of 1,395 feet of new bulkhead within 24” seaward of an existing deteriorated bulkhead along the shoreline of the planned Building A.

In F-2018-0278, or the “Hallock Bulkhead Replacement/Realignment & Dredging”, the applicant – Larry Hallock – proposes to replace in place a navy vinyl approximately 563 linear feet of bulkhead. In addition, the applicant proposes to remove 77 linear feet of bulkhead, excavate behind 77 feet portion of bulkhead to -4 feet MLW and use 145 cubic yards of excavated material as backfill. A new 90 linear feet of new navy vinyl bulkhead will be placed landward of the removed 77 linear foot bulkhead. Also, 8 foot returns are proposed at both property lines. Dredging will be 10 feet seaward to -4 feet MLW and the resultant 24 cubic yards of spoil will be used as backfill behind the 90 linear foot bulkhead. The existing 4 feet x 58 feet timber walk, 4 feet x 20 feet walk and 4 feet x 26 feet walk will be removed and replaced. An additional 4 feet x 15 feet walk will be constructed along with the installation of 6 mooring poles. The project is located at 122 South Penataquit Avenue in the Town of Islip, Suffolk County, New York on Penataquit Creek. The stated purpose of the project is for “erosion control and to provide safe mooring of private recreational vessels”.

In F-2018-0826 (FA), the New York State Division of Homeland Security and Emergency Services (DHSES), as the applicant for disaster relief funds available from the U.S. Department of Homeland Security’s Federal Emergency Management Agency (FEMA), is proposing to provide financial assistance to assist the Sea Gate Community of Brooklyn, Kings County, NY to implement the “Seagate Community Bulkhead Project”. The Sea Gate Community, is an eligible sub-recipient of these funds through FEMA’s Hazard Mitigation Grant Program (HMGP).
The sub-recipient proposes to replace the bulkhead that was destroyed by Hurricane Sandy within the project limits. The installation of the proposed bulkhead will result in a continuous line of protection measures that provide protection to a minimum of elevation 11.0 NAVD 88 (2% annual or 50-year flood event). The project would be implemented as seven sections of bulkhead along the Sea Gate Community’s western and southern shores. The structures are to be located landward of the mean high water line and will connect with the existing sections.

Correction
In the Federal Register of August 8, 2018, in FR Doc. 83-153, on page 39148, in the third column, correct the “Supplementary Information” caption to read:
SUPPLEMENTARY INFORMATION: The business meeting will include actions or presentations on the following items:
(1) informational presentation of interest to the upper Susquehanna River region; (2) release of proposed rulemaking and policies for public comment; (3) revisions to financial instruments and policies; (4) ratification/approval of contracts/grants; (5) a report on delegated settlements; (6) a proposed consumptive use mitigation project located in Conoy Township, Lancaster County, Pa.; (7) Regulatory Program projects; and (8) Lycoming County Water and Sewer Authority request for a waiver of 18 CFR § 806.31(b).
