Department of State F-2015-0841 Date of Issuance – March 2, 2016
The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the Department of State offices located at One Commerce Plaza, 99 Washington Ave., Albany, NY.
In F-2015-0841, River Rock Structured Capital, LLC, is proposing the replacement of an existing dock within the Significant Coastal Fish and Wildlife Habitat of Mecox Bay, on property located on the southwest end of Crescent Ave, in the Town of Southampton, Suffolk County. River Rock Structured Capital, LLC, proposes to remove the existing fixed timber dock and construct a new dock consisting of a 4’ x 15’ fixed timber catwalk, 3’ x 14’ ramp, and 6’ x 20’ float supported by two 8” diameter piles. The stated purpose of the proposed action is for “private boat dockage.”
Any interested parties and/or agencies desiring to express their views concerning any of the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 30 days from the date of publication of this notice, or, April 1, 2016.

The National Parks Service has determined that the proposed activity will be undertaken in a manner consistent to the maximum extent practicable with the enforceable policies of the New York State Coastal Management Program. The applicant's consistency determination and accompanying supporting information and data are available for inspection at the Department of State offices located at One Commerce Plaza, 99 Washington Ave., Albany, NY.
In F-2016-0110 (DA), the National Parks Service is proposing to construct a new 20,000 square foot museum for the Statue of Liberty National Monument on Liberty Island, New York. The proposed includes construction of a temporary pier on piles on the northern side of the island to facilitate movement of construction materials. The purpose of the project is to move the existing Statue of Liberty museum out of the Statue of Liberty’s pedestal and into a new facility on the island.
Any interested parties and/or agencies desiring to express their views concerning the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or, March 17, 2016.

The United States Environmental Protection Agency (EPA) has determined that the proposed activity will be undertaken in a manner consistent to the maximum extent practicable with the enforceable policies of the New York State Coastal Management Program. The applicant's consistency determination and accompanying supporting information and data are available for inspection at the Department of State offices located at One Commerce Plaza, 99 Washington Ave., Albany, NY. On Wednesday, February 10, 2016, the EPA submitted a consistency determination for the proposed amendments to 40 CFR Part 228 (FRL-7919-9) or the 2005 Final Rule for the Designation of Dredged Material Sites in Central and Western Long Island Sound, CT (Final Rule). DOS previously reviewed the Final Rule under DOS file no. F-2004-0228 (DA), and ultimately concurred with the site designations, subject to several restrictions. EPA is now proposing to amend the Final Rule, to incorporate standards and procedures for use of those sites as recommended in the Final Long Island Sound Dredged Material Management Plan (LISDMMP), released by the U.S. Army Corps of Engineers on January 11, 2016. A copy of the Final DMMP and related documents, can be found at: http://www.nae.usace.army.mil/Missions/ProjectsTopics/LongIslandSoundDMMP.aspx.
EPA has published the proposed amendments in the Federal Register at: https://federalregister.gov/a/2016-02585. Comments are due to the EPA in response to their notice on March 25, 2016. EPA will also be conducting Public Hearings as follows:
