Office for People With Developmental Disabilities
Announcement for Public Comment on the OPWDD 1915(c) HCBS Waiver Renewal
The NYS Office for People With Developmental Disabilities (OPWDD) hereby gives notice in order to obtain public comment on the OPWDD Comprehensive Home and Community-Based Services (1915-c HCBS) Waiver application for renewal to the Centers for Medicare and Medicaid Services (CMS). The Waiver Renewal has a retroactive effective date of October 1, 2014 and will span over the course of a five year period through September 30, 2019. This five year agreement will fund Home and Community-Based Services for over 80,000 people with intellectual and developmental disabilities. The OPWDD Comprehensive HCBS Waiver is a program of supports and services that enables adults and children with intellectual and developmental disabilities to live in the community as an alternative to Intermediate Care Facility (ICF) services. This Waiver has been in operation since 1991.
The Waiver Renewal application includes changes and additions to reflect existing operational changes and new, prospective changes.
(1) Updates reflecting operational changes that were initiated on or after 10/1/2014 include:
• Actions to assure full compliance with Federal HCBS Settings requirements effective March 17, 2014,
• Implementation of the Protection of People with Special Needs Act and Reforms to Incident Management Amendments,
• Self-direction redesign that included the transition of Consolidate Support and Services (CSS) model on October 1, 2014 to a new CMS-approved budget methodology,
• Waiver Quality Improvement Strategy updates to reflect public outreach HCBS settings transformation and the creation of the Commissioner’s Transformation Panel,
• Changes initiated in 2015 to Day and Residential Habilitation to delineate the clinician services that may be delivered as part of the scope of the Day or Residential Habilitation services, and those therapies that must be funded as a Medicaid State Plan service, and;
• Language identifying that, beginning in 2016, some people enrolled in the OPWDD Comprehensive HCBS Waiver may choose to enroll in a voluntary Managed Care program called the FIDA-IDD (Fully Integrated Duals Advantage for Individuals with Intellectual and Developmental Disabilities).
(2) Other changes in the Renewal include a request that CMS prospectively approve:
• A new interim funding methodology for people who are new to Residential and Day Habilitation Services and who need additional staff support. The interim reimbursement would remain in place until the provider agency’s certified cost reports includes the additional staffing and these costs are incorporated into the provider agency’s existing Residential or Day Habilitation rate,
• A proposal for the State to pay the higher of calculated rates when programs transition from the auspice of one provider agency to another provider agency,
• Technical change in the effective date of federal participation in special populations funding for individuals transitioning from institutions, and;
• A multi-year phase-in to a new Respite fee methodology.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue, in Albany, New York.
In F-2015-0471, The Town of Cortlandt, is proposing the construction of 12' by 80' low profile floating docks with a 12' by 22' ramp for the use of local rowing clubs. The project is proposed to be located in the waters of the Hudson River at 45 Riverview Ave. Verplank in Westchester County.

Department of State Notice of Review for the Village of Watkins Glen Draft Local Waterfront Revitalization Program
PURSUANT to Article 42 of the New York State Executive Law and 19 NYCRR Part 601, the New York State Department of State (DOS) has accepted a Draft Local Waterfront Revitalization Program (LWRP) for the Village of Watkins Glen, located within Schuyler County. The LWRP serves as a comprehensive management program for the Village’s waterfront resources along Seneca Lake and the Seneca Canal.
To approve the Village of Watkins Glen LWRP, the Secretary of State must find that it is consistent with Article 42 of the Executive Law and that it does not conflict with existing state programs and policies. Since state agency actions must be consistent with an approved LWRP, Article 42 requires that the public and any potentially affected state and regional agencies be given the opportunity to comment on the proposed program. For this purpose, the Village of Watkins Glen Draft LWRP is available online at www.dos.ny.gov/opd/programs/WFRevitalization/LWRP_draft.html.
