Notice of Intent to Submeter Electricity
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Public Service Commission is considering the Notice of Intent, filed by Gemini Residential, LLC, to submeter electricity at 225 East 39th Street, New York, New York, and the request for a waiver of 16 NYCRR § 96.5(k)(3), requiring an energy audit.
Statutory authority:
Public Service Law, sections 2, 4(1), 30, 32-48, 52, 53, 65(1), 66(1), (2), (3), (4), (12) and (14)
Subject:
Notice of Intent to submeter electricity.
Purpose:
To consider the Notice of Intent of Gemini Residential, LLC to submeter electricity at 225 East 39th Street, New York, New York.
Substance of proposed rule:
The Commission is considering the Notice of Intent, filed by Gemini Residential, LLC on May 25, 2016, to submeter electricity at 225 East 39th Street, New York, New York, located in the service territory of Consolidated Edison Company of New York, Inc. The Commission is also considering Petitioner’s request for a waiver of 16 NYCRR § 96.5(k)(3), which requires proof that an energy audit has been conducted when 20 percent or more of the residents receive income-based housing assistance. The Commission may adopt, reject or modify, in whole or in part, the relief proposed and may resolve related matters.
