Wireless Pole Attachment Rate
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a proposal filed by the City of Jamestown Board of Public Utilities to modify its electric tariff schedule, P.S.C. No. 7, to add a wireless pole attachment rate.
Statutory authority:
Public Service Law, sections 65 and 66(12)
Subject:
Wireless pole attachment rate.
Purpose:
To ensure safe and adequate service at just and reasonable rates charged to customers without preferences.
Substance of proposed rule:
The Commission is considering a proposal filed by the City of Jamestown Board of Public Utilities (Jamestown) on July 31, 2019, to amend its electric tariff schedule, P.S.C. No. 7 – Electricity, to add a wireless pole attachment rate consistent with the Commission’s Order Approving Petition in Part and Continuing Proceeding, issued March 14, 2019 (March 2019 Order).
Jamestown proposes a wireless pole attachment rate applicable to Wireless Communications Carriers of $11.98 per foot of occupied space. The proposed rate is consistent with its established wireline attachment rates applicable to Cable System Operators and Telecommunications Carriers. As indicated in the March 2019 Order, the wireless attachment rate is intended to establish a standard and non-discriminatory approach for calculating wireless attachment rates in New York. The proposed amendment has an effective date of November 29, 2019.
