Reissuance of Expired Initial Certificates and Supplementary Certificates
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
Amendment of sections 80-1.8 and 80-5.18 of Title 8 NYCRR.
Statutory authority:
Education Law, sections 207(not subdivided), 305(1), 3001(1)-(3), 3004(1) and 3009(1)
Subject:
Reissuance of expired initial certificates and supplementary certificates.
Purpose:
To provide candidates seeking a reissuance of an expired certificate or a supplementary certificate with increased flexibility.

Initial Review of Rule
As a rule that requires a RFA, RAFA or JIS, this rule will be initially reviewed in the calendar year 2020, which is no later than the 3rd year after the year in which this rule is being adopted.
Assessment of Public Comment
Since publication of Proposed Rule Making in the State Register on January 25, 2017, the State Education Department (SED) received one comment:
1. COMMENT:
One commenter recommended that candidates with an expired initial certificate should be allowed to fulfill the requirements for a reissuance of their certificate by taking professional development courses rather than retaking the required exam.
DEPARTMENT RESPONSE:
Completion of seventy-five hours of professional development and/or 50 clock hours of acceptable continuing teacher and leader education (CTLE), and/or a combination thereof prorated in a manner determined by the Department is one of the requirements for the reissuance of an initial certificate along with evidence that the candidate has retaken the content specialty test (CST) required for the initial certificate sought and received a satisfactory passing score on such examination. The proposed amendment provides more flexibility in when the candidate may complete these requirements and requires candidates to provide evidence of a satisfactory passing score on the CST and the professional development within one year of their application date. The Department believes that re-taking the content specialty test is necessary to ensure that the candidate has the requisite content knowledge for the certificate sought.
