PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On 1/20/22, the PSC adopted an order approving NextEra Energy Transmission New York, Inc.'s (NEETNY) petition for a lightened ratemaking regulatory regime in connection with its ownership and operation of the Empire State Line (ESL) transmission project.
Statutory authority:
Public Service Law, sections 2(12), (13), 5(1)(b), 64-69, 69-a, 70-72, 72-a, 105-114, 114-a, 115, 117, 118, 119-b and 119-c
Subject:
Lightened regulation.
Purpose:
To approve NEETNY's petition for a lightened ratemaking regulatory regime.
Substance of final rule:
The Commission, on January 20, 2022, adopted an order approving NextEra Energy Transmission New York, Inc.'s petition for a lightened ratemaking regulatory regime in connection with its ownership and operation of the Empire State Line transmission project in Niagara and Erie Counties, New York, subject to the terms and conditions set forth in the order.
