Authority to Update Its System Improvement Charge (SIC Mechanism)
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering whether to approve, modify or reject a petition filed by New York American Water Company, Inc. (f/k/a Long Island Water Corporation) to update projects to be covered by its System Improvement Charge (SIC Mechanism).
Statutory authority:
Public Service Law, sections 89-b and 89-c
Subject:
Authority to update its System Improvement Charge (SIC Mechanism).
Purpose:
To allow or disallow New York American Water Company to update its System Improvement Charge (SIC Mechanism).
Substance of proposed rule:
In 2012, the Commission established New York American Water Company, Inc.’s (NYAW) (f/k/a Long Island Water Corporation) current rate plan. That plan includes a System Improvement Charge (SIC) mechanism, which allows NYAW to recover carry charges for specific completed infrastructure projects until the Company’s next rate case.
In an October 27, 2014 Petition, NYAW states that the SIC projects identified in the current rate plan are either completed or near completion and proposes that the SIC mechanism be updated to include new infrastructure projects identified in the petition. The petition states that updating the SIC mechanism as proposed will allow the Company to continue to construct necessary capital improvements that benefit ratepayers, while providing NYAW with an opportunity to earn its authorized rate of return under the current rate plan.
The Commission is considering whether to approve, deny, or modify, in whole or in part, the petition to update the SIC mechanism. The Commission may consider all other related matters.
