Request for Maintenance Support
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On 7/11/19, the PSC adopted an order authorizing the New York State Energy Research and Development Authority (NYSERDA) to enter into a three-year maintenance resource contract with Northbrook Lyons Falls, LLC (Lyons Falls).
Statutory authority:
Public Service Law, sections 4(1), 5(1), (2), 66(2); Energy Law, section 6-104(5)(b)
Subject:
Request for maintenance support.
Purpose:
To authorize NYSERDA to enter into a three-year maintenance resource contract with Lyons Falls.
Substance of final rule:
The Commission, on July 11, 2019, adopted an order authorizing the New York State Energy Research and Development Authority (NYSERDA) to enter into a three-year maintenance resource contract with Northbrook Lyons Falls, LLC (Lyons Falls) to provide financial support to maintain operations of three run-of-the-river hydroelectric power plants (Facility). Lyons Falls is offered a three-year Tier 2 maintenance resource contract under the Renewable Energy Standard, with a maintenance award for the purchase of Renewable Energy Credits priced up to $7.80/MWh on up to 42,590 MWh of energy generated annually at its facility. The three-year term shall begin on or after August 1, 2019, subject to the terms and conditions set forth in the order.
