City of Buffalo City Clerk and Buffalo Water Board
Pursuant to New York State Public Authorities Law section 1048-i(7)(a), the City of Buffalo City Clerk and the Buffalo Water Board hereby give notice of the following:
Further pursuant to the provisions of Chapter 796 of the Laws of 1985 of the State of New York (the “State”), constituting the Buffalo Municipal Water Finance Authority Act, codified as Section 1048-a through 1048-bb of Title 2-B of Article 5 of the Public Authorities Law of the State, as amended (the “Authority Act”), the City of Buffalo (the “City”), the Buffalo Water Board (the “Board”) and the Buffalo Municipal Water Finance Authority (the “Authority”) are parties to a Financing Agreement dated as of September 24, 1992, as amended (the “Financing Agreement”) pursuant to which the Authority finances capital projects for the water supply and distribution system located in the City and owned by the Water Board (the “Water System”) and the Water Board imposes fees and rents on Water System users which, together with other revenues available for such purpose, if any, are sufficient to pay to the Authority debt service on bonds issued by the Authority pursuant to the Financing Agreement and for operation and maintenance of the Water System, and for the purpose of maintaining the Water System on an independent basis. Pursuant to Section 2.1 of the Financing Agreement, the Financing Agreement may, upon approval by resolution of the City, the Authority and the Board, be amended to add, delete or modify Water System capital projects to be financed by the Authority. On May 7, 2019, following a public hearing duly noticed and held in accordance with the provisions of the Authority Act, and resolutions duly adopted by their respective governing boards, the City, the Board and the Authority executed an amendment to the Financing Agreement to add certain new Water System capital projects to the Financing Agreement (the “2019 Amendment”). A copy of the complete Financing Agreement, including the 2019 Amendment, is on file for public inspection in the Office of the City Clerk of the City where the same may be examined by any interested person during regular business hours. The validity of the 2019 Amendment may be hereafter contested only upon the ground or grounds that: (i) the Financing Agreement as amended by the 2019 Amendment violates, or the performance of any provision thereof by any party thereto would violate, the provisions of any law or the New York State Constitution, or (ii) the provisions of law which should have been complied with in relation to the authorization and execution of the 2019 Amendment were not substantially complied with, and in any event an action, suit or proceeding is commenced within sixty days after the date of this notice.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program.
In F-2018-1375 or the “Bulkhead Installation at 3112 Lee Place”, the applicant Michael Bruckner, is proposing to install approximately 107 linear feet of navy style bulkhead in place, a new L- shaped pier (5′ x 33′ wood pier with a 3′ x 7′ projection and a 2′ x 2′ access step), a new 3′ x 18′ aluminum ramp, and a 8′ x 20′ wood float. The existing 4- pile boat lift will be relocated to the 5′ x 33′ portion of the L-shaped pier. The project is located at 3112 Lee Place in the Town of Hempstead (Bellmore), Nassau County on Newbridge Creek.

In F-2019-0269, or the “Raffa Shoreline Stabilization”, the applicant Charles Raffa – proposes to stabilize 153 feet of the shoreline with a row of 1.5 to 2 ton boulders, approximately 3 to 4 feet in diameter, spaced 3 feet on center. The boulders will be placed on approximately 4 inches of clean gravel. Clean sand will be placed landward of the boulders. Filter fabric will be placed between the boulder and the gravel, also between the boulder and the clean sand. The stated purpose of the project is to “protect, stabilize and enhance approximately 153 linear feet of an existing eroding bog/wetlands shoreline by installing natural rock boulders backfilling with clean sand and planting with Spartina Alterniflora”. The project is located at Six Sandpiper Court in the Town of Westhampton, Suffolk County on Moriches Bay.
