PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering an August 15, 2011 petition of New York State Electric & Gas Corp. and Rochester Gas and Electric Corp. in Case 07-M-0548 et al. for waiver of the 2011 energy savings targets for the Home Energy Reports Programs.
Statutory authority:
Public Service Law, sections 4(1), 5(2) and 66(1)
Subject:
Energy efficiency programs administered by New York State Electric & Gas Corp. and Rochester Gas and Electric Corp.
Purpose:
To waive energy savings targets regarding certain approved energy efficiency programs.
Substance of proposed rule:
The Commission is considering whether to adopt, modify, or reject, in whole or in part, or to take other action regarding a petition submitted on August 15, 2011 by New York State Electric & Gas Corporation (NYSEG) and Rochester Gas and Electric Corporation (RG&E) in the Energy Efficiency Portfolio Standard (EEPS) proceeding, Cases 07-M-0548 et al. The petition seeks a waiver from the approved electric and gas energy savings targets for the 2011 program year for Home Energy Reports Programs that were approved by the Commission in an order issued January 25, 2011 in Cases 07-M-0548 et al. The petition also requests a delay in consideration of a petition that NYSEG and RG&E filed April 15, 2011 that requested a waiver from requirement to implement the Home Energy Reports Program. The delay is requested to allow time for NYSEG and RG&E to develop a proposal for a revised program for implementation beginning in 2012. The Commission is also considering whether to make additional modifications to EEPS programs administered by New York State Electric & Gas Corporation and Rochester Gas and Electric Corporation. A Commission decision here may be applied to other utilities.
