Deferred Compensation Board
Pursuant to the provisions of 9 NYCRR, Section 9003.2, authorized by Section 5 of the State Finance Law, the New York State Deferred Compensation Board, beginning Wednesday, October 6, 2010 is soliciting proposals from Financial Organizations to provide small capitalization value no load mutual funds (or load funds in which the fees will be waived). The fund would represent one of the investment options under the Deferred Compensation Plan for Employees of the State of New York and Other Participating Public Jurisdictions, a plan meeting the requirements of Section 457 of the Internal Revenue Code and Section 5 of the State Finance Law, including all rules and regulations issued pursuant thereto.

Department of Environmental Conservation
Pursuant to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law (ECL) and the implementing regulations in 6 NYCRR Part 617, the New York State Department of Environmental Conservation hereby gives notice of the following:
Notice of Completion of the Final Generic Environmental Impact Statement associated with the New York State Hazardous Waste Facility Siting Plan
A Final Generic Environmental Impact Statement has been completed and accepted by the new York State Department of Environmental Conservation (DEC) as lead agency, located at 625 Broadway, Albany, NY 12233-7252, for the action of issuance of the New York State Hazardous Waste Facility Siting Plan (Siting Plan). A positive declaration was initially issued for this project which provided a mechanism, through the development of the GEIS, to evaluate and address any potential impacts the draft plan may have on the environment. Prior to this Notice of Completion, DEC issued two drafts of the Generic Environmental Impact Statement (GEIS) for public review.
The Siting Plan, required by ECL Section 27-1102, is primarily intended to assess the State's capacity for managing hazardous waste in accordance with State and Federal law, and to assure adequate availability of industrial hazardous waste treatment, storage and disposal facilities into the future. The final adoption of a Siting Plan is a prerequisite for the siting or significant expansion of certain new hazardous waste facilities in New York.
Potential Environmental Impacts: The Plan itself is a guidance document and has no direct environmental impacts. The GEIS does not replace the need for a separate and distinct site-specific EIS for any hazardous waste management facility that is proposed to be sited or expanded in New York State in the future.

Pursuant to subdivision 5 of Section 23-1101 of the Environmental Conservation Law, the New York State Department of Environmental Conservation hereby gives public notice of the following:
The Department has determined that public bids for the leasing of a parcel of State land totaling 1.02 acres of the Finger Lakes DDSO in the Town of Big Flats, Chemung County for oil and natural gas production is unreasonable and impracticable.
The Department intends to lease such lands to Anschutz Exploration Corporation for such purpose.

Office for People with Developmental Disabilities
Pursuant to 42 CFR 447.205, the NYS Office For People With Developmental Disabilities and NYS Department of Health hereby give notice of the following changes in methods and standards for setting payment rates for residential habilitation services in supervised Individualized Residential Alternatives (IRAs) and supervised Community Residences (CRs). The change will be effective October 1, 2010.
OPWDD is changing the reimbursement methodology to allow a provider to apply to OPWDD for a waiver or reduction of all or part of two components of the efficiency adjustment for residential habilitation services provided in supervised IRAs and supervised CRs. In order to qualify, the provider must demonstrate that the reduction in reimbursement attributable to the application of the efficiency adjustment would jeopardize the continued operation of its IRA or CR facilities.
The purpose of this change is to avert any facility closures and the accompanying disruption in services to individuals that could result.
The change will result in a small increase in annual aggregate Medicaid expenditures for residential habilitation services in supervised IRAs and supervised CRs. However, the State does not know exactly how many providers meet the qualifications for the restoration of revenue and the level of restoration. This aggregate restoration is expected to be less than $50,000.
Public hearings on this change will be held at OPWDD Counsel's Office Conference Room, 3rd Floor, 44 Holland Avenue, Albany, New York 12229 at 10:30 A.M. on November 30, 2010 and December 1, 2010.
