Department of Health and Office of Mental Health
Pursuant to 42 CFR 447.205, the New York State Office of Mental Health and the New York State Department of Health hereby give public notice of the following:
The State proposes to amend the Title XIX Medicaid State Plan for the provision of mental health clinic services. Effective October 1, 2010, the New York State Office of Mental Health will commence transitioning the basis for reimbursement of clinic services from a methodology based upon regionally-based fees per visit to regionally-based fees using outpatient procedures that are grouped for payment purposes under Ambulatory Patient Groups (APGs), which are based upon the intensity of the service and the medical procedures performed. For non-hospital based clinics, the transition to the new system will be accomplished over a four-year period. Providers will be reimbursed using a fee of which 75% is comprised of the existing Medicaid fee-for-service reimbursement and 25% APG-based in year one; in year two, 50% of the fee will be based upon the current reimbursement and 50% APG-based. In year three, 25% of the fee will be based upon the current reimbursement and 75% the APG-based fee. In year four and subsequent years, the fee will be entirely APG-based. Hospital-based mental health clinics will join the APG transition schedule which is now in its second year and immediately receive payments based on 50% of their current reimbursement and 50% APG-based. They will proceed through year three beginning January 2011, and beginning January 2012, their fees will be entirely APG-based.
The proposed amendment to the State Plan will not result in a change in aggregate Medicaid expenditures.

Office for People with Developmental Disabilities
Pursuant to 42 CFR 447.205, the NYS Office For People With Developmental Disabilities and NYS Department of Health hereby give notice of the following:
Effective October 1, 2010 OWPDD will be revising its regulations to implement Health Care Adjustment (HCA) VI applicable to Medicaid payments for Residential Habilitation, Day Habilitation, Supported Employment, Prevocational Services, Respite, Community Residential Habilitation, Article 16 Clinics, ICF/DDs, Day Treatment, Plan of Care Support Services and Family Education and Training. The proposed amendments will increase reimbursement to providers of the referenced programs and services so as to enable them to sustain or enhance employee health care related benefits and/or to help their employees defray the ever increasing costs of health care.
The adjustments will be calculated as a percentage applied to the allowable operating costs of the specific program or service as reflected in the prices, rates or fees. OPWDD has determined a benchmark of health care coverage and has identified provider agencies that meet or exceed the benchmark criteria. In recognition of health care costs being incurred and to serve as a model toward which all providers should strive, providers which offer coverage at or above the benchmark will receive for each adjustment either a 3.0 percent increase to their allowable operating costs in the rates and prices of trended programs or a 1.0 percent increase to their allowable operating costs in the rates and prices of all covered programs. Providers not in this category may apply to OPWDD to receive funding equivalent to 1.0 percent of their allowable operating costs in the rates and prices of covered programs. The application must specify the intended use of the funds from among the required and approved uses. Approved applicants shall be required to use these funds to offset health care premium increases. Remaining funds shall be used to establish health care related benefits or to reduce employee out-of-pocket health care related expenses. Approved applicants must also assure board authorization and agree to maintain records to substantiate distribution of these funds consistent with their applications. Funds are subject to audit to assure compliance with these regulations.
Health Care Adjustment VI contains catch-up provisions to fund providers as though HCA VI had been implemented on April 1, 2010.
The implementation of HCA VI will result in an annual aggregate increase of approximately $28.1 million in reimbursements to affected providers of developmental disabilities services. This approximate $28.1 million cost in Medicaid will be evenly shared by the State (approximately $14 million) and the federal (approximately $14 million) governments.

Pursuant to 42 CFR 447.205, the NYS Office For People With Developmental Disabilities and NYS Department of Health hereby give notice of the following:
OPWDD proposes to change its methods and standards for setting Medicaid prices for residential habilitation services in supervised Individualized Residential Alternatives (IRAs) and supervised Community Residences (CRs). The change will implement an efficiency adjustment to the IRA price effective October 1, 2010.
The efficiency adjustment will have three components. The first component of this adjustment is an 18 percent reduction applied to Non Personal Services (NPS) operating costs contained in the supervised IRA price for providers ranked at or above the 15th percentile. The second component of the adjustment is a 5 percent reduction applied to Total Program Administration and Total Agency Administration operating costs contained in the supervised IRA price for providers at or above the 15th percentile. The third component of this adjustment is a residual adjustment that confines the aggregate effect of this efficiency adjustment and an offset factor of $44 per unit of service to a range between a minimum of 1.5 percent and a maximum of 3.5 percent of the total supervised IRA price. The offset factor is put in place to avoid duplication of funding and reduces State funding in recognition of other revenues received by providers.
The efficiency adjustment is expected to result in a $50 million decrease in annual aggregate Medicaid expenditures for supervised residential habilitation services.
This measure is designed to encourage providers to seek efficiencies in their operations. Because of budgetary uncertainty, many providers had not incorporated any trend increases into their fiscal planning. OPWDD expects that the additional funding attributable to the trend factors which providers only realized after February 1, 2010 may have bolstered their fiscal positions sufficiently for them to absorb the efficiency adjustment without detriment.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
In F-2010-0586, Aquifer Drilling and Testing, Inc. is proposing to drill eight marine borings for exploratory purposes in Haverstraw Bay on underwater lands owned by U.S. Gypsum and the State of New York in the Town of Haverstraw, Rockland County, New York. The borings are being installed to collect subsurface information for the design of a water intake line. Approximately eight borings will be drilled via a drill rig mounted on a barge. The four inch boreholes will extend approximately 100' below the mudline into the Hudson River bottom. Boreholes will be grouted in-place via tremie pipe with cement-bentonite grout as the drill casing is removed from the borehole. The proposed activity will result in a total of approximately 3 cubic yards of fill. The area where the proposed borings will be drilled is within the State-designated Haverstraw Bay Significant Coastal Fish and Wildlife Habitat.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

Department of State F-2010-0676 (DA) Date of Issuance - August 25, 2010
The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The United States Department of Homeland Security, U.S. Coast Guard has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2010-0676 DA, the U.S. Coast Guard, is proposing to perform maintenance dredging of the boat basin moorings at the USCG Station Rochester boat basin, located at 5500 St. Paul Boulevard, and at the USCG Auxiliary Moorings Rochester, located at 520 River Street, within the Genesee River, City of Rochester, County of Monroe. The proposal involves the maintenance dredging of the mooring areas to the following dimensions:
• Mechanically dredge approximately 3,000 cubic yards (cy) of material from an approximately 40,600 square foot area of the USCG Station Rochester boat basin to a depth of 7 to 8 feet. This area is comprised of a 325' x 120' area immediately adjacent to the bulkhead, and a 20' x 80 boat slip.
• Mechanically dredge approximately 800 cy of material from an approximately 3960 square foot area of the USCG Auxiliary Moorings boat basin to a depth of 7 to 8 feet. This area is comprised of a 132' x 30' area immediately adjacent to the bulkhead.
The proposal as described, will remove up to 3800 cubic yards of material from within the USCG mooring areas. All material is proposed to be placed at the Lake Ontario open-water disposal site located approximately 1.5 miles northeast of the East Pier Light at Rochester Harbor.
The stated purpose of this proposal is to provide better access to the refueling areas and to correct difficulties in docking and launching boats due to insufficient depths. The riverbed is not currently at sufficient depth for the USCG search and rescue boats utilized by the USCG Rochester for maritime safety.

Department of Taxation and Finance Interest Rates
The Commissioner of Taxation and Finance hereby sets the interest rates for the months of October, November, December, 2010 pursuant to sections 697(j) and 1096(e) of the Tax Law, as follows:
For purposes of section 697(j) the overpayment rate of interest is set at 3 percent per annum, and the underpayment rate of interest is set at 7-1/2 percent per annum. For purposes of section 1096(e), the overpayment rate of interest is set at 3 percent per annum, and the underpayment rate of interest is set at 8 percent per annum. (The underpayment rates set pursuant to sections 697(j) and 1096(e) may not be less than 7-1/2 percent per annum.) Pursuant to section 1145(a) (1) of the Tax Law, the underpayment rate for State and local sales and use taxes administered by the Commissioner of Taxation and Finance is 14-1/2 percent per annum. The underpayment rate for the special assessments on hazardous waste imposed by section 27-0923 of the Environmental Conservation Law is 15 percent.

* The Tax Law requires the interest rate on sales tax assessments or late payments to be set at 14-1/2% for this quarter. However, if the Commissioner determines that the failure to pay or the delay in payment is due to reasonable cause and not willful neglect, the Commissioner may impose interest at the corporation tax late payment and assessment rate. That rate is 8% for this quarter.
** There are a number of state and local governmental bodies that have interest rates tied to the overpayment and underpayment rates contained in either section 697(j) (Income Tax) or section 1096(e) (Corporation Tax) of the Tax Law. For purposes of section 697(j) and section 1096(e) of the Tax Law, the overpayment rate for this period is 3%. For purposes of section 697(j) of the Tax Law, the underpayment rate for this period is 7.5%. For purposes of section 1096(e) of the Tax Law the underpayment rate for this period is 8%.

Pursuant to Section 9-0505 of the Environmental Conservation Law, the Department of Environmental Conservation hereby gives Public Notice for the following:
Sealed bids for 191.2 MBF, more or less, of misc. hardwood sawtimber and 295 cords, more or less, of miscellaneous hardwood firewood, located on Otsego Reforestation Area No. 9, Stands C-5, 13, and D-10, will be accepted at the Department of Environmental Conservation, Bureau of Procurement & Expenditure Services, 625 Broadway, 10th Fl., Albany, NY 12233-5027 until 11:00 a.m., Thursday, Sept. 2, 2010.
