Commission Proceeding Concerning Treatment of Tennessee Pipeline Refund
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is initiating a proceeding mandating gas utilities that received, or will receive, a portion of the Tennessee Pipeline refund to describe how each proposes to treat/disburse the refund and explain why the proposal should be accepted.
Statutory authority:
Public Service Law, sections 2, 65, 66, 107 and 113
Subject:
Commission proceeding concerning treatment of Tennessee Pipeline refund.
Purpose:
Initiation of Tennessee Pipeline refund proceeding.
Substance of proposed rule:
The Public Service Commission (Commission) is initiating a proceeding requesting all New York State gas utilities that have, or will receive, a share of the Tennessee Gas Pipeline Company refund approved by the Federal Energy Regulatory Commission in Docket Nos. RP91-203-76 and RP92-132-064 to submit a filing describing how each proposes to treat/disburse its refund share, and if necessary, explain why such treatment should not be consistent with Commission Order in Case 09-G-0354. The Commission may grant, deny or modify, in whole or in part, the filings submitted, and may also consider related matters.
