PROGRAM TO SUPPORT AND ENHANCE LOCAL PROSECUTORS' EFFORTS TO GENERATE REVENUE OWED TO THE STATE

The New York State Division of Criminal Justice Services (DCJS) is issuing a Request for Applications (RFA) to solicit applications for grant awards to support and enhance local prosecutors’ efforts to generate revenue owed to the State through effective investigation and prosecution of revenue-related crimes.

Subject to State appropriation authority, approximately $15 million in funding is available for awards to District Attorneys offices currently participating in the Crimes Against Revenue Program and newly-eligible District Attorneys offices in targeted jurisdictions as outlined in the RFA. Contracts will be awarded for a period of 12 months beginning October 1, 2010 and ending September 30, 2011.

Draft 2011 Intended Use Plans (IUPs); Anticipated Funds Available; Project Priority Lists; Eligible Projects; Public Meeting & Hearing; Comments; Applications

The New York State Environmental Facilities Corporation (EFC), the Department of Environmental Conservation (DEC) and the Department of Health (DOH) are pleased to announce the availability of the draft Federal Fiscal Year (FFY) 2011 Intended Use Plans (IUPs) for the Clean Water State Revolving Fund (CWSRF) and the Drinking Water State Revolving Fund (DWSRF). The CWSRF and DWSRF programs are available to municipalities and certain non-municipal entities in NYS to finance water quality related projects. EFC estimates that approximately $375.0 million will be available for subsidized financing for the CWSRF during FFY 2011. This includes an estimated federal capitalization grant amount of $211.6 million, with an estimated maximum of $63.4 million to be made available for eligible projects as additional subsidization. Additionally, EFC estimates that a minimum of $42.3 million will need to meet Green Project Reserve criteria. DOH estimates that approximately $275.0 million in subsidized financing will be available for the DWSRF during FFY 2011. This includes an estimated federal capitalization grant amount of $89.0 million, of which a maximum of $26.7 million will be made available for eligible hardship projects as additional subsidization as hardship grants. The IUPs include lists of projects that could receive low-interest subsidized and unsubsidized financing between October 1, 2010 and September 30, 2011, the next IUP financing period. The interest rate for subsidized financings is ½ (CWSRF) or 1/3 (DWSRF) of the market rate for bonds. Please visit EFC’s website at www.nysefc.org for more information.

ELIGIBLE PROJECTS:

CWSRF - Municipal water pollution control projects eligible for CWSRF low-interest subsidized and unsubsidized financing under Section 212 of the Clean Water Act (CWA) include, but are not limited to: wastewater treatment facilities and conveyance systems; combined sewer overflow abatement facilities; stormwater pollution abatement; energy efficiency initiatives; system security measures; water conservation, reuse and recycling systems; and other municipally-owned projects or portions of projects that maintain, protect or improve water quality.

Municipal and non-municipal entities may apply for CWSRF assistance for non-point source projects which protect water quality under CWA Section 319 or implement an approved National Estuary Plan under CWA Section 320. Projects eligible for CWSRF low-interest subsidized and unsubsidized financing include, but are not limited to: land acquisition or conservation easements for water quality protection, including wellhead protection; brownfield remediation; contaminated soil and storage tank remediation; water quality aspects of landfills such as landfill leachate collection, storage and treatment, landfill gas collection and control, and landfill capping; stormwater management facilities and equipment; wetland and waterbody restoration; highway deicing materials storage; deficient or failing decentralized septic systems; or other non-point source projects to maintain, protect or improve water quality under Section 319.

DWSRF - Drinking water systems eligible for DWSRF low-interest subsidized and non-subsidized financing are: municipal and privately-owned community water systems and non-profit, non-community water systems. Municipally-owned water systems are also eligible for low-interest unsubsidized financing. Projects eligible for DWSRF financing include: construction, rehabilitation, and upgrading of water treatment plants; transmission and distribution mains; storage facilities; pump stations; interconnections; rehabilitation or development of new drinking water sources; consolidation of water supply services; upgrades to existing water systems; energy efficiency initiatives; and capital investments to improve security of drinking water systems.

INTENDED USE PLANS & PROJECT LISTING:

Eligible entities interested in financing one or more projects not currently listed in the draft CWSRF IUP or draft DWSRF IUP should submit the appropriate IUP project listing information before Friday, August 27, 2010 as provided below. For assistance with the IUP listing process, please call the EFC or DOH office listed at the end of this notice.

For CWSRF projects, an applicant will need to provide a CWSRF Project Listing Form and an approvable engineering report or technical report to EFC by August 27, 2010 to be listed for financing of projects on the Annual List of the final CWSRF IUP. Separate listing forms are available for municipal wastewater and nonpoint source projects, for municipal and not-for-profit land acquisition projects, and for non-municipal nonpoint source projects.

For DWSRF projects, an applicant will need to provide a DWSRF Pre-Application Form and an engineering report or plans and specifications to the DOH by August 27, 2010, or have completed construction, to be included on the Project Readiness List in the final DWSRF IUP.

A notice regarding the availability of the draft IUPs will be mailed to municipal applicants, system owners, financial advisors, consulting firms, and other interested parties. Copies of the draft IUPs will be available at New York State Documents Depository Libraries. The CWSRF IUP will also be available on the EFC website at www.nysefc.org (click on "Programs", then "Clean Water State Revolving Fund", then "Intended Use Plan"). The DWSRF IUP will also be available on the DOH website at www.health.state.ny.us (click on the "Topics A to Z" button, "Drinking Water", and "Drinking Water State Revolving Fund").

DUE DATE FOR COMMENTS:

Written statements or comments on the draft IUPs can be filed prior to the August 27, 2010 deadline or at the public hearing. If you intend to provide testimony at the public hearing, please provide a copy of the testimony prior to or at the beginning of the hearing. Written and oral statements will be made part of the official records. PUBLIC MEETING & HEARING:

A joint public meeting and hearing to review the draft FFY 2011 CWSRF IUP and DWSRF IUP will be held on Thursday, August 5, 2010 at 10:00 AM in the Stedman Room of the William K. Sanford Town Library in the Town of Colonie, Albany County. The Library is located at 629 Albany Shaker Road, approximately ¼ mile east of Exit 4 off I-87. Pre-registration is not required. Reasonable accommodations will be provided for disabled persons if requested in advance.

WEBINAR:

EFC and DOH will host a webinar on Wednesday, August 11, 2010, at 2:00 PM. This event will present an overview of the 2011 IUPs for the CWSRF and the DWSRF, as well as an opportunity to answer questions. Log-on instructions for this webinar will be posted on EFC's website at www.nysefc.org.

PROGRAMS TO SUPPORT COUNTIES THROUGH THE EMERGENCY MANAGEMENT OFFICES

Fiscal Year 2010 Companion Animal Sheltering Equipment Grant Program seeks applications for up to $60,000 in federal State Homeland Security Program (SHSP) funding made available by the NYS Office of Homeland Security (OHS) to develop regional capabilities to provide temporary emergency sheltering for pets and companion animals during emergencies and disasters. New York State utilizes the nationally recognized County Animal Response Team (CART) model to develop and promote animal response capabilities across the State. The three primary objectives of the CASE Grant Program are: 1) Develop regional capabilities to provide temporary emergency animal sheltering through the procurement of regional mobile equipment caches; 2) To enhance CART capabilities through regional partnerships, establishing a cost effective and efficient method of providing evacuation, sheltering and transportation of pets and companion animals throughout the State; and 3) To enhance human evacuation compliance by building sustainable temporary emergency animal sheltering capabilities through the development of mobile equipment caches that will overcome known barriers to compliance with evacuation orders.

Applications will be accepted from June 1, 2010 through August 4, 2010 through the State’s electronic grants management system (E-Grants) for programs to support counties through the emergency management offices. Additionally, because of the regional focus of this specialized grant program, OHS will NOT accept applications from individual counties; rather, two or more counties must apply together for a regional project. PROGRAMS TO SUPPORT LOCAL, COUNTY AND TRIBAL LAW ENFORCEMENT AGENCIES

Fiscal Year 2010 Explosive Detection Canine Team Grant Program seeks applications for up to $50,000 in federal State Homeland Security Program funding made available by the NYS Office of Homeland Security (OHS) to develop explosive detection canine team capabilities. The four primary objectives of this grant are: 1.) The advancement of explosive detection canine team capabilities; 2.) The certification of explosive detection canine teams and compliance with annual re-certification requirements; 3.) Participation in DHS’s Office for Bombing Prevention’s Explosive Detection Canine Capability Analysis Program; and, 4.) Promotion of regional partnerships in the development of mutual explosive detection canine team capabilities.

MUNICIPALITY (CITIES, VILLAGES, TOWNS^[1], FIRE DISTRICTS AND COUNTIES

Fiscal Year 2010 Technical Rescue Grant Program seeks applications up to $150,000 in federal State Homeland Security Program (SHSP) funding made available by the NYS Office of Homeland Security (OHS) for local emergency response entities that provide targeted technical rescue and urban search and rescue (USAR) related services. This grant focuses on technical rescue and USAR related services involving structural collapse, trench, confined space, swift water and/or rope rescues in an all-hazards environment. For the purposes of this grant, vehicle and machinery rescue activities are not considered technical rescue. The three primary objectives of this grant are: (1) Advancement of Targeted Technical Rescue and USAR Capabilities; (2) Development of Regional Response Capabilities; and (3) Increasing the Resource Typing of Technical Rescue and USAR Resources in New York State. Applicable standards include the Federal Emergency Management Agency (FEMA) National Incident Management System (NIMS) Resource Typing for search and rescue where applicable and, for those capabilities not addressed within the NIMS System, the National Fire Protection Association (NFPA) 1670 - Standard on Operations and Training, Technical Search and Rescue Incidents.

A municipality (cities, villages, towns^[1], fire districts and counties) is eligible to apply for the FY2010 Technical Rescue & USAR Grant Program on behalf of one or more emergency response entities. For purposes of this grant program, an “emergency response entity” is strictly defined as an entity that provides technical rescue or USAR services located in New York State. The emergency response entity must already be established and maintained by one or more municipalities and must be a resource identified in the county fire mobilization and mutual aid plan.
