The New York State Office of Mental Health hereby gives notice that it is amending its State Medicaid Plan to require Medicaid to pay up to the regular Medicaid fee for Medicare reimbursable services in Personalized Recovery Oriented Services (PROS) programs, even if that fee is higher than the Medicare approved amount.

Department of State F-2010-0254 (DA) Date of Issuance - May 19, 2010
The New York State Department of State (DOS) is required by Federal law to provide timely public notice for the activity described below, which is subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The United States Department of Homeland Security, United States Coast Guard, has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination, Notice of Proposed Rulemaking and Draft Programmatic Environmental Impact Statement (DPEIS) are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2010-0254 (DA), the U.S. Coast Guard (USCG) has submitted a consistency determination for the proposed regulatory action to establish a nationwide ballast water discharge standard which vessel owners would comply with to prevent or reduce the introduction and spread of nonindigenous species in U.S. waters. The USCG is pursuing its mandate under the National Invasive Species Act of 1996 (Pub. L. 104-332).
The USCG has stated within their submission that the proposed rule would establish standards for the allowable concentration of living organisms in ships' ballast water discharged in U.S. waters; establish an approval process for ballast water management systems; and reduce and prevent the introduction and spread of nonindigenous species from ships discharging ballast water in U.S. waters.
The proposed rule includes a phase-in schedule for complying with both the phase one and the phase two proposed ballast water discharge standards (BWDS), based on each vessel's ballast water capacity and build date. The USCG has analyzed 5 alternatives as a basis for these standards. Alternative 1 is the no action alternative; Alternative 2 (the USCG proposed phase one standard and the preferred alternative) sets limits for concentrations of organisms per 100 milliliters (mL) of ballast water; Alternative 3 is 10 times more stringent than Alternative 2; Alternative 4 is 100 times more stringent than Alternative 2 and is equivalent to the NYS water quality certification for existing vessels that is part of the USEPA Vessel General Permit (VGP), and Alternative 5 is essentially the sterilization of ballast water. As noted, the USCG proposed phase one standard corresponds to Alternative 2; it also corresponds to the International Maritime Organization (IMO) standard that some countries have adopted. The USCG phase 2 standard does not correspond to any of the analyzed alternatives but falls between Alternatives 4 and 5. It is 1000 times more stringent than Alternative 2 and is approximately equivalent to the NYS water quality certification for new vessels that is part of the USEPA Vessel General Permit (VGP).
