Office of Mental Retardation and Developmental Disabilities
Pursuant to 42 CFR 447.205, the NYS Office of Mental Retardation and Developmental Disabilities and NYS Department of Health hereby give notice of the following:
OMRDD proposes to change its methods and standards for setting Medicaid prices for group day habilitation services. The change will implement an efficiency adjustment effective May 1, 2010.
The efficiency adjustment will have two tiers. The first tier will be a 2.5 percent reduction in operating reimbursement and will be applied to all Medicaid prices for group day habilitation services. The second tier of the adjustment is a 4.29 percent reduction in reimbursement for Non-Personal Services (NSP) and is applied only to providers that exceed the 40th percentile in a ranking of providers according to their reimbursable NPS operating costs as a percentage of total operating costs contained in the reimbursement price. The second tier reduction is applied to gross NPS reimbursable operating costs in the price in effect on May 1, 2010 without consideration of the effect of the first tier reduction.
The efficiency adjustment is expected to result in a $28 million decrease in annual aggregate Medicaid expenditures for group day habilitation services.
This measure is designed to encourage providers to seek efficiencies in their operations. Consolidated fiscal reporting for group day habilitation programs in recent years suggests that reimbursement has been adequate to sustain optimal program requirements and economies are eminently possible.
