PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering the petition of Garrow Water Works Company, Inc. requesting approval of a loan agreement with TD Bank, N.A. in the amount of $150,000 to finance water system upgrades.
Statutory authority:
Public Service Law, sections 89-b(1), 89-c and 89-h
Subject:
The issuance of a $150,000 loan to finance water system upgrades.
Purpose:
Consideration of approval for a loan of $150,000 to finance water system upgrades.
Text of proposed rule:
On October 27, 2009, Garrow Water Works Company, Inc. (the company) filed a petition requesting Public Service Commission approval to enter into a financing agreement of approximately $150,000 with TD Bank, N.A., in order to make water system improvements, and to institute a customer surcharge to support the financing. The company provides unmetered water service to 47 residential customers located in the Town of Schuyler Falls, Clinton County. The Commission may approve or reject, in whole or in part, or modify the company’s petition.
